10.40.010 Unlawful inhalation of toxic fumes.
A. It is unlawful for any person to intentionally smell or inhale the fumes of any substance containing a solvent having the property of releasing toxic vapors or fumes, or to induce any other person to do so, for the purpose of causing a condition of or inducing symptoms of intoxication, elation, euphoria, dizziness, excitement, irrational behavior, exhilaration, paralysis, stupefaction, or dulling of the senses of the nervous system, or for the purpose of, in any manner, changing, distorting, or disturbing the audio, visual, or mental processes; provided, this section shall not be construed as applying to the inhalation of any anesthesia for medical or dental purposes.
B. Unlawful inhalation of toxic fumes is a misdemeanor, and, upon conviction thereof, shall be punished by a fine not to exceed one hundred dollars or by imprisonment for not more than thirty days, or by both. (Ord. 3133-09 § 1, 2009: mended during 1988 supplement; Ord. 1145-85 § 110, 1985)
10.40.020 Possession of certain substances prohibited.
A. No person may, for the purpose of violating Section 10.40.010, use, or possess for the purpose of so using, any substance containing a solvent having the property of releasing toxic vapors or fumes.
B. Possession of certain substances in violation of subsection A of this section is a misdemeanor and, upon conviction thereof, shall be punished by a fine not to exceed one hundred dollars or by imprisonment for not more than thirty days, or by both. (Ord. 3133-09 § 2, 2009)
10.40.030 Sale of certain substances prohibited.
A. No person may sell, offer to sell, deliver, or give to any other person any container of a substance containing a solvent having the property of releasing toxic vapors or fumes, if he has knowledge that the product sold, offered for sale, delivered, or given will be used for the purpose set forth in Section 10.40.010.
B. Selling, offering to sell, delivering or giving another person any container of a substance in violation of subsection A of this section is a misdemeanor and, upon conviction thereof, shall be punished by a fine not to exceed one hundred dollars or by imprisonment for not more than thirty days, or by both. 10.40.040 Definition.
As used in this chapter, the phrase “substance containing a solvent having the property of releasing toxic vapors or fumes” shall mean and include any substance containing one or more of the following chemical compounds:
A. Acetone;
B. Amylacetate;
C. Benzol or benzene;
D. Butyl acetate;
E. Butyl alcohol;
F. Carbon tetrachloride;
G. Chloroform;
H. Cyclohexanone;
I. Ethanol or ethyl alcohol;
J. Ethyl acetate;
K. Hexane;
L. Isopropanol or isopropyl alcohol;
M. Isopropyl acetate;
N. Methyl “cellosolve” acetate;
O. Methyl ethyl ketone;
P. Methyl isobutyl ketone;
Q. Toluol or toluene;
R. Trichloroethylene;
S. Tricresyl phosphate;
T. Xylol or xylene; or
U. Any other solvent, material, substance, chemical, or combination thereof having the property of releasing toxic vapors. (Ord. 3133-09 § 4, 2009)
