16.64.010 Established—Purpose.

There is created and established a board of review (board of appeals), hereinafter referred to as the “board,” for the purpose of determining the suitable alternate materials, alternate types and methods of construction regarding the following codes:

A.    Uniform Building Code as adopted and now and hereafter amended by the city council;

B.    Uniform Mechanical Code as adopted and now and hereafter amended by the city council;

C.    Uniform Fire Code as adopted and now and hereafter amended by the city council;

D.    Uniform Plumbing Code as adopted and now and hereafter amended by the city council;

E.    National Electrical Code and Department of Labor and Industries Rules for Electrical Construction as adopted and now and hereafter amended by the city council;

F.    The provisions of Ordinance No. 4321 as set forth in Chapter 16.52*, as adopted and hereafter amended by the city council, relating to the construction of all piers, wharves, bulkhead structures and similar facilities built adjacent to or over water, bayshores and waterways within the city;

G.    Washington State Energy Code and the Washington State Ventilation and Indoor Air Quality Code as adopted and now and hereafter amended by the city council. (Ord. 2337-98 § 1, 1998: Ord. 351-75 § 1 (part), 1975)

16.64.020 Membership—Rules and regulations.

The board shall consist of seven members who are qualified to pass upon matters pertaining to the codes and ordinances set forth in Section 16.64.010. The department head who has the responsibility regarding the particular code under consideration by the board shall be an ex officio member of the board and shall act as secretary of the board. The board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the appropriate department head responsible for the code under consideration with a duplicate copy to the appellant. The decision of the board constitutes a recommendation to the city council. (Ord. 2069-95 § 1, 1995: Ord. 351-75 § 1 (part), 1975)

16.64.030 Appeal procedure.

Any person or persons aggrieved by an order or action of the appropriate city official charged with the responsibility of enforcing the provisions of the respective codes or ordinances set forth in Section 16.64.010 may appeal from such order or action by filing a written appeal with the city clerk. Appeals from written orders of the responsible official must be filed within thirty calendar days from the date of receipt of the written order by the aggrieved party. Such time limitation shall not apply to oral orders or directions given by the responsible official. (Ord. 351-75 § 2, 1975)
