46.65.010 Conditions for use—Form.

The public works director, or his designee, is authorized to establish conditions for use of the electronic speed monitoring device by persons other than city employees which shall include the following minimum conditions:

1.    Said device shall be available to local service groups or organizations;

2.    Said device shall not be used outside the Everett city limits;

3.    Said organizations shall execute a consent and release substantially in the following form:

AGREEMENT FOR USE OF ELECTRONIC

SPEED MONITORING DEVICE

The undersigned person represents that he is an authorized representative of ___ and does hereby request the City of Everett to grant to the undersigned organization the right to use the electronic speed monitoring device belonging to the City of Everett, for the purpose of encouraging speed reduction and traffic safety in the City of Everett. Said organization does hereby agree to save harmless the City of Everett, the Mayor, and officers and employees for any and all claims for personal injury or damage to property that may be suffered by said person or to others in connection with use of said device. In addition, the undersigned agrees to indemnify and save harmless the City of Everett, its officers and employees, from all claims for personal injury or damage to properly that may be brought against the undersigned arising out of his or her own acts while using said device and shall provide evidence of general liability insurance with a minimum of $500,000 per person/per occurrence. The undersigned agrees to accept responsibility for any and all damage to said device, reasonable wear and tear excepted.

46.65.020 Use by neighborhood groups.

Neighborhood groups recognized as members of the council of neighborhoods, are authorized to use the speed monitoring device(s) under the following conditions:

1.    The neighborhood group shall submit for approval by the traffic engineer a use program, designating the specific location or locations where the device will be used, time of use, specifying person(s) to have custody of the device and other details as may be required by the traffic engineer.

2.    Only persons trained to use the device by the traffic engineer, or his/her designee, shall use the device.

3.    Said groups shall follow the procedures established in Section 46.65.020; provided that said groups shall be exempted from the insurance/hold harmless requirements. (Ord. 1717-90 § 2, 1990)
