19.31.010 Purpose.
The purpose of the commercial zone is to provide for the location and grouping of retail uses having common or similar performance standards and to intentionally concentrate a maximum variety of facilities within the zone for the convenience of shoppers on a community-wide basis as distinguished from neighborhood areas, and to promote pedestrian circulation patterns. 19.31.015 Compliance with construction and performance standards required.
All uses in the commercial zone, whether principal permitted or accessory or conditionally permitted uses, shall comply and be consistent with the size and construction standards and performance standards set forth under EMC 19.31.040 and 19.31.050. [Ord. 705 § 1, 2010.]
19.31.020 Permitted uses.
The uses permitted within the commercial zone as a matter of right are as follows:
A. Any retail business whose principal activity is the sale of new merchandise in an enclosed building.
B. Restaurants and cafes.
C. Taverns.
D. Professional offices, medical and dental clinics.
E. Barber and beauty shops.
F. Service oriented businesses, including but not limited to delicatessens, dry cleaners, laundries and shoe repairs.
G. Drug stores.
H. Grocery stores.
I. Parking lots.
J. Shopping centers.
K. Service stations, fueling stations and electric vehicle battery charging stations.
L. Auto repair shops and car wash.
M. Lumber yards, building supply and home improvement stores.
N. Commercial recreation facilities, excluding those uses identified as conditional uses under EMC 19.31.030.
O. Retail businesses whose principal activity is the sale of second-hand or used merchandise in an enclosed building.
P. Art, photography, dance, music or voice studios.
Q. Tattoo, piercing or body art studio.
R. Video arcade.
S. Antique store.
T. Art gallery.
U. Appliance repair.
V. Banks, credit unions and business, financial, information and social service offices.
W. Fitness center and martial arts studio.
X. Adult family home.
Y. Feed store, pet store and animal grooming.

19.31.025 Accessory uses.
The accessory uses permitted in the commercial zone are as follows:
A. Any use customarily incidental to the permitted principal use, such as associated vehicular parking.
B. Offices supporting a principal use.
C. Retail or wholesale of goods that are produced or processed on site. [Ord. 705 § 3, 2010.]
19.31.030 Conditional uses.
The following conditional uses may be permitted within the commercial zone by the City Council upon application and in accordance with Chapter 19.11 EMC:
A. Food processing and/or production.
B. Multiple-family dwellings (two or more residential units), except where such development fronts onto Main Street between Everson Road and Blair Drive.
C. Accessory dwelling units over commercial.
D. Daycare facilities, including adult daycare.
E. Bed and breakfast where consistent with EMC 19.27.050.
F. Hotels, motels and inns.
G. Drive-through restaurant and drive-up window for any permitted or conditionally permitted use.
H. Automobile and vehicular sales and service businesses.
I. Theatre or cinema.
J. Bowling alley or skating rink.
K. Nursing home, skilled nursing facility, convalescent home or extended care facility.
L. Retirement home or assisted living facility.
M. Funeral home and undertaking establishments.
N. Churches, schools, clubs and lodges.
O. Warehousing, assembly and light manufacturing.
P. Veterinary hospital or clinic.
Q. Flea market.

19.31.035 Prohibited uses.
The following uses are prohibited within the commercial zone:
A. All other uses not permitted or conditionally permitted. [Ord. 705 § 5, 2010.]
19.31.040 Size and construction standards.
The following size and construction standards shall be applicable to uses in the commercial zone:
A. Minimum lot size: none.
B. Minimum lot width: none.
C. Maximum Building Height. The maximum building height in a commercial zone is 35 feet; provided, that heights up to 45 feet may authorized by the City Council through approval of a conditional use permit pursuant to Chapter 19.11 EMC.
D. Setbacks.
1. Front yard: 20 feet.
2. Rear yard: 15 feet.
3. Side yard: five feet, except on corner lots where the side yard setback shall be equal to the front yard setback.
E. Lots abutting West Main Street, Washington Street between Lincoln Street and West First Street, and Harkness Street between McCaskill and West First Street shall have no required front or side yard setbacks.
F. Maximum lot coverage: 75 percent; provided, that lot coverage greater than 75 percent may be authorized by the City Council through approval of a conditional use permit pursuant to Chapter 19.11 EMC.
G. Frontage Improvements. Unless determined by the City to be unnecessary at the specific location, frontage improvements shall include:
1. Curbs and gutters;
2. Sidewalks;
3. Catch basins and drainage facilities; and

19.31.050 Performance standards.
The following performance standards shall be applicable to uses in the commercial zone:
A. Emissions of smoke, dust and other particulate matter, and of toxic and noxious gases and fumes shall meet or exceed standards set by the local air pollution authority (Northwest Clean Air Agency) and all Washington State and Federal air quality standards.
B. Vibration caused by each use shall be so minimized that the ground vibration does not occur and is not detectable at any point on or beyond the commercial district boundary in which the use is located.
C. Uses producing heat, glare and/or steam shall be carried on in such a manner that the heat, glare or steam shall not intrude beyond the boundary lines of the district within which the use is located. Building materials with high light-reflective qualities shall not be used in construction of buildings so that reflected sunlight will not result in intense glare affecting areas surrounding the zone. Artificial lighting shall be hooded or shaded so that direct light or high-intensity lamps will not result in glare when viewed from areas surrounding the zone.
D. Noise and sound levels shall not exceed levels established by noise control regulations of the Department of Labor and Industries. Maximum permissible environmental noise levels within the zone and beyond the zone boundaries shall be as established by the State of Washington Department of Ecology under WAC 173-60-040.
