10.48.010 Maximum speed.

It is unlawful for any person in charge of any railroad car, train or locomotive to run or move the same within the corporate limits of the city at a greater speed than 45 miles per hour. (Ord. 598 § 1, 1981).

10.48.020 Time limit on street crossings.

It is unlawful for any person having charge or control of any railway car, locomotive or railway train, to allow the same to remain upon or prevent or interfere with the use of the 54th Avenue East crossing for a period of time longer than five consecutive minutes, except for through train movements. (Ord. 598 § 2, 1981).

10.48.030 Switching during peak traffic hours.

No switching operations, picking up or setting out of cars on the tracks at the Tacoma Junction shall be permitted on or across the 54th Avenue East crossing between the hours of 6:30 a.m. and 8:30 a.m. and between the hours of 3:00 p.m. and 6:30 p.m. (Ord. 598 § 3, 1981).

10.48.040 Switching operations defined.

“Switching operations” are defined as any of the following: the starting and stopping, coupling and uncoupling and/or moving back and forth of engines, trains, or parts of trains on, or across, any public crossing. (Ord. 598 § 4, 1981).

10.48.050 Obeying watchmen or flagmen.

A. It shall be the duty of persons before walking across or driving or propelling any vehicle or causing any vehicle to be driven or propelled across any railroad crossing within the corporate limits of the city upon which a flagman or watchman is kept or maintained to observe said watchman or flagman and to promptly obey any signal, sign, or warning that may be given by such watchman or flagman, pertaining to the use of said crossing.

B. No pedestrian or vehicle shall pass through, around, over or under any crossing gate or barrier at a railroad grade crossing which such gate or barrier is closed or is being opened or closed.

C. Whenever any person driving a vehicle approaches a railroad grade crossing under any of the circumstances stated in subsection (B) of this section, the driver of such vehicle shall stop within 50 feet, but not less than 15 feet from the nearest rail of such railroad and shall not proceed until he can do so safely. (Ord. 598 § 5, 1981).

10.48.060 Penalty.

Any knowing violation of the provisions of this chapter or any knowing failure to comply with the requirements of this chapter shall be a misdemeanor. (Ord. 1777 § 1 (Exh. A), 2012; Ord. 842 § 12, 1986; Ord. 598 § 6, 1981).
