6.04.010 Owner – Duty to dispose.
It shall be the duty of any owner, tenant or occupant of any property or place whatsoever within the corporate limits of the city to dispose of any and all refuse, garbage and waste material thereon. [Ord. 848 § 1(A), 2013; Ord. 265 § 1A, 1974.]
6.04.020 Owner – Receptacles.
It shall be the duty of such owner, tenant or occupant to provide and furnish metal containers for use as garbage receptacles on the premises. [Ord. 265 § 1B, 1974.]
6.04.030 Receptacle – Capacity.
No customer served by garbage cans shall use a garbage can in excess of 32 gallons in capacity and weighing in excess of 65 pounds. [Ord. 330 § 2.1, 1982; Ord. 289 § 2.1, 1980.]
6.04.040 Receptacle – Condition.
All garbage cans shall have a tight-fitting lid and shall be maintained in good and clean condition. [Ord. 330 § 2.2, 1982; Ord. 289 § 2.2, 1980.]
6.04.050 Receptacle – Maintenance.
Each customer shall provide the cans necessary to serve the needs of the location and shall be solely responsible for the maintenance and condition of such cans. [Ord. 330 § 2.3, 1982; Ord. 289 § 2.3, 1980.]
6.04.060 Waste – Packaging.
All items of waste and refuse which by their nature cannot be placed in standard unit receptacles shall be packaged for disposal and shall not be allowed to become a hazard to the public health or welfare. [Ord. 265 § 1E, 1974.]
6.04.070 Garbage collector.
The city council may contract with any garbage collector or paid monthly collector to provide adequate garbage collection and disposal services with the city. [Ord. 848 § 1(A), 2013; Ord. 265 § 2, 1974.]
6.04.080 Garbage service – Reasonable.
Garbage service by a person or persons under contract to provide the same shall be provided at such times and in such manner particularly described in the contract therefor and shall comply with all reasonable standards of public health and welfare. [Ord. 265 § 3A, 1974.]
6.04.090 Garbage – Rates.
The city garbage services shall be at the rates and specifications as provided for by special ordinance or general ordinance. [Ord. 848 § 1(A), 2013; Ord. 333, 1982; Ord. 315 § 1, 1980.]
6.04.110 Garbage collection – Unauthorized.
It shall be unlawful for any person or persons other than such as may be for the time under contract with the city to collect, haul, handle or dispose of for another for compensation of any kind whatsoever any refuse, garbage or other waste material ordinarily classed as garbage, or to burn within the fire limits of the city any garbage, crates, boxes, papers, straw, grass or other combustible material of any kind, except in an incinerator provided for that purpose. 6.04.130 Dumpster – Location.
Any customer served by a dumpster shall provide a location adequate for the placing of the dumpster, which location and access thereto shall be approved by the city engineer or his designee. [Ord. 848 § 1(A), 2013; Ord. 330 § 3.1, 1982; Ord. 289 § 3.1, 1980.]
6.04.140 Dumpster – Access.
The customer shall maintain clear access to the dumpster. [Ord. 330 § 3.2, 1982; Ord. 289 § 3.2, 1980.]
6.04.150 Dumpster – Condition.
The customer shall maintain the dumpster in good condition and shall keep the area around it in a clean and sanitary condition. [Ord. 330 § 3.3, 1982; Ord. 289 § 3.3, 1980.]
6.04.170 Monthly charges.
The following monthly charges shall be charged for a single-family dwelling:
(A) One or two garbage cans, $6.00 per month;
(B) For each garbage can in excess of two, a charge of $1.75 per can per pickup will be charged. [Ord. 333, 1982.]
6.04.180 Charges for mobile homes and trailers.
(A) One or two garbage cans, $6.00 per month;
(B) For each garbage can in excess of two, a charge of $1.75 per can per pickup will be charged. [Ord. 333, 1982.]
6.04.190 Charges for gas stations.
(A) One or two garbage cans, $6.00 per month;
(B) For each garbage can in excess of two, a charge of $1.75 per can per pickup will be charged. [Ord. 333, 1982.]
6.04.200 Charges for churches and other nonprofit public meeting places.
(A) One or two garbage cans, $6.00 per month;
(B) For each garbage can in excess of two, a charge of $1.75 per can per pickup will be charged. [Ord. 333, 1982.]
6.04.210 Charges for business and commercial establishments.
(A) One or two garbage cans, $6.00 per month;
(B) For each garbage can in excess of two, a charge of $1.75 per can per pickup will be charged. [Ord. 333, 1982.]
6.04.220 Charges for apartments, duplexes, triplexes, fourplexes, or other multi-unit dwellings.
(A) One or two garbage cans, $6.00 per month;
(B) For each garbage can in excess of two, a charge of $1.75 per can per pickup will be charged. [Ord. 333, 1982.]
6.04.230 Dumpster – Provided by city.
(A) In the event that any single-family dwelling, apartment, duplex, triplex, fourplex, or other multi-unit dwelling, mobile home, trailer, business or commercial establishment, gas station, church or other nonprofit public meeting place is unable to dispose of any and all refuse, garbage and waste material in three or fewer receptacles as defined in GFMC 6.04.030, the city shall serve such customer with a dumpster.
(B) In the event that any customer is served with a dumpster as provided in this section, the customer shall abide by GFMC 6.04.130 through 6.04.150, inclusive. [Ord. 848 § 1(A), 2013; Ord. 333, 1982.]
6.04.240 Charges for dumpsters.
(A) A charge of $18.75 per month shall be paid to the city for rental of the dumpster.
(B) A charge of $4.70 shall be charged for each emptying of the dumpster. [Ord. 848 § 1(A), 2013; Ord. 333, 1982.]
6.04.250 Senior citizen discount.
(A) For purposes of garbage rates, a senior citizen shall be defined as any person 62 years of age or older.
(B) For each senior citizen serviced by one or two garbage cans, a charge of $4.50 per month shall be charged.
(C) For each senior citizen having a garbage can in excess of two, a charge of $1.00 per can per pickup will be charged.
(D) Provided, however, that the senior citizen discount referred to in this section shall not apply to customers serviced in business or commercial establishments. [Ord. 333, 1982.]
6.04.260 Elections – Lien.
All charges for garbage disposal service shall become due and payable at the office of the city treasurer on or before the tenth day of each month and shall become delinquent thereafter. Any charge for garbage disposal service rendered but not paid by the tenth day of each month as provided in this section shall immediately become a lien upon the property to which such garbage service is rendered, and such lien shall be superior to all liens and encumbrances filed subsequent to this lien except the lien of general taxes and local improvement assessments whether levied prior or subsequent thereto; provided, that in the event the garbage charges are not paid by the tenth day of each month, a penalty may assessed and charged for each month the charge remains delinquent. The penalty may be charged and assessed each and every month against any delinquent accounts. [Ord. 848 § 1(A), 2013; Ord. 333, 1982.]
6.04.270 Leases.
In the event that there exists a rental agreement for garbage containers and dumpsters with the city the current rates and charges will go into effect at the expiration of the lease. [Ord. 848 § 1(A), 2013; Ord. 333, 1982.]
