VESSEL NOISE

RCW 79A.60.130 requiring effective mufflers or underwater exhaust systems for vessels and Chapter 352-67 WAC relating to vessel sound level measurement procedures are hereby adopted by reference. [Ord. 512 § 1, 2015]
14.35.020 Excessive noise prohibited.
(1) “Excessive noise” means any noise which unreasonably intrudes upon the peace and quiet of persons on the water or on the shore. “Excessive noise” includes, but is not limited to, the sound of amplified voices or music.
(2) All excessive noise, in addition to the noise regulated under the provisions adopted by reference in HPMC 14.35.010, emanating from vessels is prohibited. Furthermore, it is unlawful for any person to negligently cause, make or allow to be made from audio equipment under such person’s control or ownership sound from a watercraft that can be clearly heard by a person of normal hearing at a distance of 300 feet or more from the watercraft itself. 14.35.030 Violation – Penalty.
Violation of the provisions of this chapter shall constitute a civil infraction punishable by a fine not to exceed $100.00; provided, that any second or subsequent infraction occurring within a period of seven days from the date of the prior infraction shall be punishable by a fine not to exceed $500.00.
