8.28.010 Unnecessary noises prohibited.
The creation of any unreasonably loud, disturbing and unnecessary noise in the city is prohibited. Noise of such character, intensity and duration as to be detrimental to the life or health of any individual is prohibited. (Ord. 3041 § 1, 1986)
8.28.020 Unlawful acts designated.
The following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this code, but such enumeration shall not be deemed to be exclusive:
A. Blowing Horns, Etc. The sounding of any horn or signal device on any automobile, motorcycle, bus or other vehicle while not in motion, except as a danger signal if another vehicle is approaching apparently out of control, or if in motion, only as a danger signal after or as brakes are being applied and deceleration of the vehicle is intended; the creation by means of any such signal device of any unreasonably loud or harsh sound; and the sounding of such device for an unnecessary and unreasonable period of time.
B. Building Operation. The erection (including excavation), demolition, alteration or repair of any building or structure other than between the hours of seven a.m. and ten p.m., except in the interest of public safety or necessity, the hours may be extended with a permit from the city manager, while the emergency or necessity continues.
C. Exhaust Discharge. The discharge into the open air of any stationary internal combustion engine, motor vehicle or motor boat engine except through a muffler or other device which will effectively prevent loud noises therefrom.
D. Fireworks. The use of firecrackers and other noise making explosives and devices except as permitted by the ordinances of the city.
E. Keeping of Animals. The keeping of any animal or fowl which by causing frequent or loud noise shall disturb the comfort and repose of any persons in the vicinity.
F. Loading and Unloading Operations. The creation of a loud and excessive noise in connection with loading or unloading any vehicle or the opening and destruction of bales, boxes, crates and containers.
G. Noises Near Churches, Etc. The creation of any excessive noise on any street adjacent to any church, school, institution of learning or court while the same are in session, or adjacent to any hospital, which unreasonably interferes with the workings of such institutions, provided conspicuous signs are displayed in such streets indicating that the same is a church, school, hospital or court street.
H. Noises to Attract Attention. The use of any instrument or device which generates excessive noise for the purpose of attracting attention or intending to attract attention to any performance, show, sale or display of merchandise.
I. Playing of Radio, Phonograph, Etc. The playing of any radio, phonograph or any musical instrument in such a manner or with such volume particularly during the hours between ten p.m. and seven a.m. as to annoy or disturb the quiet, comfort or repose of persons in any dwelling, hotel or other type of residence.
J. Use of Vehicles. The use of any automobile, motorcycle or vehicle so out of repair, so loaded or in such manner as to create loud and unnecessary grating, grinding, rattling or other noise. (Ord. 3422 § 1, 1999; Ord. 3174 § 1, 1991; Ord. 3041 § 2, 1986)
8.28.030 Violation—Penalty.
Any person violating any of the provisions of this chapter shall, upon conviction thereof, be punished by a fine of not to exceed the sum of five hundred dollars, or by imprisonment for a period of not to exceed six months, or by both such fine and imprisonment. (Ord. 3041 § 3, 1986)
