6.12.010 Permit – Required for keeping.
It is unlawful to keep, harbor or own any number of horses, mules, donkeys, llamas, cows, rabbits, chickens, turkeys, geese, ducks or any other livestock within the limits of the city except under a permit as provided for in this chapter, first obtained from the city council.
(1) Permits for keeping of caged livestock such as chickens, rabbits, turkeys, geese and ducks, as described in KMC 6.12.030, shall meet the following requirements:
(a) No more than four will be permitted at any one location.
(b) Male chickens over four months old are not allowed.
(c) Permitted livestock must be kept in well ventilated, enclosed coops, cages, or hutches, constructed to protect livestock against weather conditions and predators and have an enclosed run for livestock. The coop, cage, or hutch and run shall provide a minimum of 10 square feet of ground space per animal permitted.
(d) All coops, cages, hutches and runs shall be located in rear yard only. Coops, cages, and hutches shall be at least 25 feet from any neighboring dwelling and a minimum of 10 feet from any property line. No portion of any run shall be within 10 feet of any property line unless the property line abuts an alley.
(e) All coops, cages, hutches and runs shall be kept in neat, sanitary, dust-free condition and must be cleaned on a regular basis as to prevent odors.
(f) All feces and waste from permitted animals must be removed from property on a weekly basis.
(2) Potbelly Pigs.
(a) No potbelly pig may be kept as a domestic pet in the city if it is greater than 22 inches in height at the shoulder or more than 150 pounds in weight.
(b) Potbelly pigs must be licensed in accordance with Chapter 6.02 KMC titled “Animal Control.” (Ord. 18-006 § 1; Ord. 14-022; Ord. 02-672 § 1; Ord. 137 § 1, 1967).
6.12.020 Permit – Application – Hearing.
Any person, firm or corporation desiring to keep livestock within the limits of the city shall submit an application, with the appropriate nonrefundable application fee, to the clerk stating the kind of livestock, number, and place desired to keep the livestock. Permit applications for cooped, caged, or hutched animals will require a site plan showing location of enclosure as well as dimensions and distances from property lines, to verify compliance with KMC 6.12.010(1). Applicants shall provide a maintenance and disposal plan in accordance with KMC 6.12.010 with their application. A hearing shall be held upon the application before the council, at which inhabitants of the city may appear and be heard for or against the application. The city council, in passing on the application, shall take into consideration the health and welfare of the residents of the city in the vicinity of the place where the livestock would be kept. 6.12.030 Permit – Granting or refused.
If the permit is refused, no other application shall be considered by the council for keeping livestock at the same place for a period of one year. If the permit is granted, the place where the livestock is kept shall be supervised by the designated city official and will be charged an annual inspection fee. A permit to have livestock within the city limits shall be granted only for one year at a time, January 1st to December 31st. A new permit must be applied for every year. 6.12.040 Permit – Revocation.
Council may revoke a permit after a hearing held on the same as if it were a hearing on the original application for a permit, should the council believe from the testimony and evidence introduced at the hearing that the keeping of livestock at the place is a menace to the health and welfare of the inhabitants living in the vicinity of the place where the livestock is kept. 6.12.050 Unlawful to keep, harbor or own.
It shall be unlawful to keep, harbor or own goats, sheep, or swine within the city limits. Swine shall not include potbelly pigs as defined in KMC 6.02.020. (Ord. 18-006 § 1; Ord. 14-022; Ord. 02-672 § 2; Ord. 279 Att. A § 2, 1978; Ord. 137 § 5, 1967).
6.12.060 Violation – Penalty.
The first and second offenses are punishable by a fine of not more than $150.00 each. Any offense thereafter shall be punishable as provided in the general penalty codified in Chapter 1.16 KMC. (Ord. 18-006 § 1; Ord. 14-022; Ord. 02-672 § 3).
