10.26.010 Permit for oversize or overweight vehicles.

(1) A special permit may be granted by the mayor upon application in writing and good cause being shown therefor, authorizing the applicant to operate or move a vehicle or combination of vehicles of a size, weight of vehicle, or load exceeding the maximum set forth in RCW 46.44.010, 46.44.020, 46.44.030, 46.44.034 and 46.44.041 upon any city street.

(2) Loads which, in the opinion of the city of Kittitas, have the potential for inhibiting the normal flow of traffic shall be prohibited from moving on city streets between the hours of 5:30 a.m. and 9:00 a.m. and 3:00 p.m. and 6:00 p.m.

(3) Oversize or overweight loads shall not be moved on legal or observed holidays of the city of Kittitas.

(4) Oversize or overweight loads will not be allowed if, at the discretion of the chief of police or an agent thereof, inclement weather, including but not limited to snow, ice, or fog, could create unsafe operating conditions.

(5) No overweight permit shall be issued to any vehicle or combination of vehicles unless the vehicle or combination of vehicles is licensed for the maximum gross weight allowed by law.

(6) Permits shall be issued for one vehicle and one trip only.

(7) Travel is limited to Main Street from I-90 to Patrick Avenue and Patrick Avenue from west city limits to east city limits.

(8) Permit applications shall be made in writing at least three business days in advance of the proposed movement.

(9) The application for oversize or overweight permits shall be in the form prescribed by the city. The permit shall require the following information:

(a) Name, address and telephone number of the applicant.

(b) Nature of the load (type of material and/or equipment to be transported).

(c) Location by name and address of job site or place of delivery.

(d) Proposed route to be approved by the city setting forth the streets and alleys upon which the vehicle will be driven.

(e) Estimate of time in days that the permit will be required.

(f) Vehicle type, year and license number.

(g) Gross licensed weight of the vehicle.

(h) Vehicle axle information.

(i) Proof of liability insurance as required by state law.

(10) For applicants transporting the same oversize or overweight load on both a state highway and city streets, the applicant shall attach the WSDOT special motor vehicle oversize/overweight permit to the permit application. (Ord. 19-008 § 1).

10.26.020 Permit fee.

Fees for such special permits shall be assessed and collected by the permit authority in accordance with the following fee schedule:

(1) All over-legal loads, including overweight, single trip: $15.00.

(2) Continuous operation of over-legal loads having either over-width or over-height features only for a period not to exceed 30 days: $20.00.

(3) Continuous operation of over-legal loads having over-length features only for a period not to exceed 30 days: $20.00.

(4) Continuous operation of a three-axle vehicle with a fixed load, having less than 65,000 pounds gross weight for a period not to exceed 30 days: $50.00.

(5) Continuous operation of overweight vehicles with nonreducible loads for a period of one year: $150.00.

(6) Continuous operation of over-legal loads having nonreducible features not to exceed 65 feet in length or eight feet, six inches in width, or 14 feet in height, for a period of one year: $150.00. (Ord. 19-008 § 1).

10.26.030 Liability for damage to streets, bridges, or elevated structures.

Any person operating a vehicle or moving any object or conveyance upon a street in this city or upon a bridge or elevated structure which is a part of any such street shall be liable for all damages which such street, bridge, or elevated structure may sustain as a result of any illegal operation of such vehicle or the moving of any such object or conveyance or as a result of the operation or moving of any vehicle, object, or conveyance weighing in excess of the legal weight limits allowed by law. When such operator is not the owner of the vehicle, object, or conveyance but is so operating or moving the same with the express or implied permission of the owner thereof, the owner and the operator shall be jointly and severally liable for any such damage. Such damage to any city street or structure may be recovered in a civil action instituted in the name of the city. Any measure of damage to a city street by reason of this section shall be prima facie the amount of damage done and shall be presumed to be the amount recoverable in a civil action therefor. 10.26.040 Display of permit.

Every special permit issued under this chapter shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any peace officer or authorized agent of any authority granting such permit. (Ord. 19-008 § 1).

10.26.050 Violation.

Any violation of this chapter will be subject to a C civil penalty under Chapter 1.16 KMC and impound as outlined in Chapter 10.20 KMC, Model Traffic Ordinance. (Ord. 19-008 § 1).P
