SKATEBOARDS, GO-CARTS AND OTHER LOCOMOTIVE DEVICES

9.16.040 Violation – Penalties.
9.16.010 Definitions.
As used in this chapter, the following terms shall have the meanings ascribed to them in this section:
A. “Skateboard” means a flat or curved board, mounted on two or more casters or wheels, manually propelled, and usually made of wood, plastic or fiberglass.
B. “Go-cart” means a framework mounted on two or more casters or wheels, that can be drawn or pushed by hand, or is motorized, and is normally assembled from materials found around the home. (Ord. 981 § 1, 2008; Ord. 362 § 1, 1986)
9.16.020 Operation.
It is unlawful for any person to operate a skateboard, go-cart or other locomotive device:
A. In a manner endangering or likely to endanger the safety of persons or property;
B. Upon any roadway open to vehicular travel; upon any public sidewalk without yielding to any pedestrian; or upon any public sidewalk in front of any building which has doors which open onto or from the sidewalk;
C. Upon any sidewalk, parking lot or alleyway in a commercial area open to the public;
D. On a skateboard while sitting, lying or otherwise being positioned such that at least one foot is not on the flat surface of the skateboard at any one time;
E. While being towed or pushed by any motorized vehicle. (Ord. 981 § 1, 2008; Ord. 362 § 2, 1986)
9.16.030 Exceptions.
A. Skateboards, go-carts or roller skates may be operated on roadways open to vehicular travel which terminate in a dead-end or cul-de-sac, provided operators of such devices yield to all vehicular traffic and pedestrians and in a manner which is unlikely to endanger the safety of persons or property.
B. Sleds, toboggans, inner tubes or skis may be operated on roadways open to vehicular traffic which terminate in a dead-end or cul-de-sac, provided operators of such devices yield to all vehicular traffic and pedestrians and in a manner which is unlikely to endanger the safety of persons or property. 9.16.040 Violation – Penalties.
A violation of any provision of this chapter, which constitutes a first, second or third offense, is a traffic infraction, which shall be processed and administered according to the procedures set forth in Chapter 46.63 RCW. The penalty for any infraction established under this chapter shall be $175.00. In addition, the court may order the confiscation and forfeiture of any skateboard, go-cart or other locomotive device used in any violation of this chapter. (Ord. 981 § 1, 2008; Ord. 362 § 4, 1986)
