9.20.010 Definitions – Adoption by reference.

The following definition sections of the Revised Code of Washington (RCW) are adopted by reference as if set forth in full and are applicable within the city:

9.20.020 Charitable and nonprofit gambling activities – Adoption by reference.

The following sections of the Revised Code of Washington (RCW) are adopted by reference as if set forth in full and are applicable within the city:

9.46.0315    Raffles – No license required when gross revenues do not exceed $5,000

9.46.0321    Bingo – No license required when gross revenues do not exceed $5,000

9.20.030 Chapter not applicable to state lottery.

The provisions of this chapter shall not apply to the conducting, operating, participating, or selling or purchasing of tickets or shares in the “lottery” or “state lottery” as defined in RCW 67.70.010 when such conducting, operating, participating, or selling or purchasing is in conformity to the provisions of Chapter 67.70 RCW and to the rules adopted thereunder. 9.20.040 Fishing derbies exempted.

Any fishing derby defined under RCW 9.46.0229 shall not be subject to any other provisions of this chapter of this code. (Ord. 596 § 5, 1995)

9.20.050 Gambling offenses.

A. The following sections in the Revised Code of Washington (RCW) are adopted by reference as if set forth in full and are applicable within the city:

B. The following sections of the Revised Code of Washington are not adopted by the reference in subsection A of this section and are expressly deleted:

C. Prohibition of Other Gambling Activities. A raffle for which a gambling license is required is a permitted gambling activity. All other gambling activities, other than those activities specifically approved, or addressed in this chapter, for which a gambling license is required are absolutely prohibited, in accordance with the provisions of RCW 9.46.295. Absolutely prohibited, for example, are social cardroom gambling, punchboards and pull tabs, and bingo for which a gambling license is required. (Ord. 596 § 6, 1995)

9.20.060 Penalties.

Any person violating any of the terms of this chapter shall:

A. If such violation concerns a violation of LFPMC 9.20.050, then such person so violating the terms of LFPMC 9.20.050 shall be guilty of a gross misdemeanor, except if such violation concerns a violation of RCW 9.46.195 adopted by reference in LFPMC 9.20.050, then such person so violating shall be guilty of a misdemeanor.

B. If such violation concerns any other activity under this chapter for which a penalty is not prescribed, then such violator so violating the terms of this chapter shall be guilty of a misdemeanor.

C. Notwithstanding the existence or use of any other remedy, the city may seek legal or equitable relief to enjoin any acts or practices which constitute or will constitute a violation of any business license ordinance or other regulations herein adopted. Accordingly, the following sections of the Revised Code of Washington (RCW) are adopted by reference as if set forth in full and are applicable within the city:
