Chapter 10.12 PARKING

A. The provisions of this section are instituted to protect the public health, safety and welfare by regulating the parking or standing of motor vehicles upon the streets designated in this section. This section is enacted pursuant to RCW 46.61.570(2).

B. Parking or standing of a motor vehicle for more than four hours between the hours of 6:00 a.m. and 6:00 p.m., Monday through Friday, shall be prohibited on all city streets where signs are so posted. For purposes of posting signs and designating streets, the chief of police may designate which streets shall be posted.

C. The police department is authorized to impound, at the owner’s risk and expense, any vehicle found to be in violation of this section two or more times within a six-month period. (Ord. 824 § 6, 2000; Ord. 251 §§ 1 – 3, 1979)

10.12.011 Impounding vehicles.

Any vehicle that is found unattended, on any portion of public property, shall be subject to immediate impound and may be removed by or at the direction of a police officer under the following circumstances:

A. The vehicle is a hazard such that it is blocking a crosswalk or other similar conduct that poses a danger or risk to the public; or

B. The vehicle is in violation of any parking regulation in this chapter; or

C. The vehicle is parked in violation of the terms of an impound warning notice as defined in RCW 46.55.085.

The cost of such impound, removal, and all subsequent storage of the vehicle shall be borne by the operator or owner of the vehicle. (Ord. 1092 § 1, 2015)

10.12.012 Parking of unregistered vehicles.

It is a parking infraction to park, stand, or allow to remain, on any public property, a vehicle without displaying valid vehicle registration as required per Chapter 46.16A RCW. (Ord. 1092 § 2, 2015)

10.12.013 Separate violation for each 24-hour period.

For purposes of this chapter, each additional 24-hour period that a vehicle remains in violation of any given section shall be considered a separate and distinct violation and subject to separate enforcement action. (Ord. 1092 § 3, 2015)

10.12.015 No extended parking.

No one shall park or permit a privately owned vehicle to remain on any highway, street, public right-of-way, or public property located within the city of Lake Forest Park for more than 72 hours.

No person shall move and repark a vehicle on either side of a highway, street or public right-of-way within the same block in order to avoid a parking time limit. A violation of this section constitutes a parking infraction subject to the penalties and processes of this chapter. (Ord. 960 § 1, 2007; Ord. 824 § 1, 2000)

10.12.016 Interference with parking monitoring.

No one shall alter or remove any mark placed upon a vehicle’s tire by a police officer to monitor and enforce parking limits established in this chapter. (Ord. 1092 § 5, 2015; Ord. 824 § 2, 2000)

10.12.017 Parking regulations for trucks and trailers.

No one shall park or permit a truck or trailer or any type of construction equipment to be parked on any public right-of-way in any residential zone of the city at any time unless actively engaged in the loading or unloading of materials or passengers, or in connection with an approved construction project or work performed on property or properties during daylight hours; provided, that the phrase “truck or trailer” shall not be construed to mean recreational vehicles, trailers and pickup trucks, with or without a canopy, that are not used for commercial purposes and do not have lettering or logos.

It is not necessary that restricted parking or other traffic signs be erected for the purpose of enforcing this section. (Ord. 960 § 2, 2007)

10.12.018 Support services officer authority.

10.12.020 Ballinger Way N.E. from NE 195th to Bothell Way (SR 522).

A. No person shall stop, stand or park a vehicle, except in compliance with the directions of a peace officer or by permit obtained at City Hall, on that portion of the public highway adjacent to the traveled lanes of that portion of Ballinger Way N.E. 10.12.030 Bothell Way N.E.

10.12.040 Definitions adopted by reference.

All sections of Chapter 46.04 RCW as now or hereafter amended are adopted by reference as a part of this chapter in all respects as though such sections were set forth herein in full. In addition the following definitions are adopted:

“City” means the city of Lake Forest Park.

“Planting strip” means that portion of a highway lying between the constructed curb, or edge of the roadway, and the property line exclusive of the sidewalk area. (RCW 46.90.154)

“Police or police officer” means and includes the police officers of the city for the purposes of this chapter.

“Police chief or chief of police” means and includes the police chief or chief of police of the city, for the purposes of this chapter.

“Police department” means and includes the police department of the city, for the purposes of this chapter.

“School bus zone” means a designated portion of the highway along the curb reserved for loading and unloading school buses during designated hours. (RCW 46.90.169)

“Street” means a city street. (RCW 46.90.175) (Ord. 552 § 1, 1993)

10.12.050 Disabled parking – Violation.

A. A parking space or stall for a disabled person shall be indicated as provided in RCW 46.61.581, as now in effect or hereafter amended.

B. Free Parking by Disabled Persons.

1. Free Parking in Certain Restricted Zones. Any person who has a parking placard pursuant to RCW 46.19.010 shall be allowed to park, free of charge, a vehicle irrespective of posted time limits that may otherwise be applicable. Provided, however, that the city may provide designated on-street parking spaces for persons with disabilities and in those spaces, where signs are so posted, the parking of such a person’s vehicle shall be prohibited for more than four hours, Monday through Friday, between the hours of 6:00 a.m. and 6:00 p.m.

2. Free Parking Does Not Apply Where No Parking Permitted. The free parking provisions of this section do not apply to the following:

a. Those zones or areas in which the stopping, parking or standing of all vehicles is prohibited; or

b. Those zones which are reserved for special types of vehicles; or

c. Any vehicle parked on public property for more than 24 hours.

3. Special Placard, Card, Decal or License Plate Needed. To be authorized for the privileges under this section, a person shall, pursuant to RCW 46.19.010, obtain and properly display a special placard, card, decal or license plate as provided under RCW 46.19.030.

C. Unauthorized Parking in Space Designated for Person with Disabilities.

1. Parking Infraction. It is a parking infraction for any unauthorized person to stop, stand or park a vehicle in, or otherwise make inaccessible, a parking space or stall marked as reserved for persons with disabilities.

2. Inaccessible Access Aisle – Parking Infraction. It is a parking infraction for a person to park in, block, or otherwise make inaccessible the access aisle located next to any parking space reserved for persons with disabilities.

3. Penalty. Violation of subsection (C)(1) or (C)(2) of this section shall be punishable by a maximum monetary penalty of $250.00, not including court fees and all other applicable assessments. The clerk of the court shall report all violations related to this subsection to the State of Washington Department of Licensing.

4. Defense to Violation – Evidence of Permit. If a person is issued a notice of infraction pursuant to this subsection, the person shall not be determined to have committed such infraction, if the person produces in court, or before their court appearance to a duly authorized representative of the court, the special placard, card, decal or license plate as required under RCW 46.19.030. 10.12.055 Adoption of state law.

The following statute of the state of Washington (now in effect and as subsequently amended) is adopted by reference as if set forth in full: RCW 46.61.581. (Ord. 1092 § 8, 2015; Ord. 762 § 7, 1998)

10.12.060 Clear roadway.

No person shall stand or park a vehicle upon a street, excluding alleys in such a manner as to leave available less than 10 feet of the width of the roadway for free movement of vehicular traffic. (RCW 46.90.433) (Ord. 552 § 3, 1993)

10.12.065 Parking of junk vehicles prohibited.

A. No one shall park or leave a junk vehicle on any highway, street, public right-of-way, or public property located within the city of Lake Forest Park for more than 24 hours.

B. For purposes of this section, a “junk vehicle” means the same as defined in RCW 46.55.010(5), as now enacted or hereafter amended. (Ord. 1092 § 9, 2015; Ord. 824 § 4, 2000)

10.12.070 No parking on crosswalk.

No person shall stop, stand or park a vehicle on a crosswalk. (RCW 46.61.570(a)(iv)) (Ord. 552 § 4, 1993)

10.12.080 No parking within 20 feet of a crosswalk.

No person shall stand or park a vehicle within 20 feet of a crosswalk. (RCW 46.61.570(b)(iii)) (Ord. 552 § 5, 1993)

10.12.090 Double parking prohibited.

No person shall stop, stand or park a vehicle with its side next to or adjacent to another vehicle which is stopped, standing or parked on a street, or alley, except while angle parking. (RCW 46.61.570(a)(i)) (Ord. 552 § 6, 1993)

10.12.100 No parking in front of driveway or within five feet.

No person shall stand or park a vehicle in front of a public or private driveway within a street or alley or in front of or in an alley entrance or within five feet of the end of a constructed driveway return or alley entrance return, or if none, within five feet of the projection of the edge of the driveway or alley. 10.12.110 No parking on bridge or in tunnel.

No person shall stop, stand or park a vehicle upon any bridge or other elevated structure upon a street or alley or within a street tunnel or alley tunnel. (RCW 46.61.570(a)(vii)) (Ord. 552 § 8, 1993)

10.12.120 No parking obstructing excavation.

No person shall stop, stand or park a vehicle alongside or opposite any street or alley excavation or obstruction when such stopping, standing or parking would obstruct traffic. (RCW 46.61.570(a)

10.12.130 No parking within 500 feet of fire apparatus.

No person shall stop, stand or park a vehicle within 500 feet of any fire apparatus, or other fire department emergency operation stopped in answer to a fire alarm. It is a defense to violation of this section that a vehicle was so parked prior to the fire department’s responding to such fire alarm. (RCW 46.61.635) (Ord. 552 § 10, 1993)

10.12.140 No parking so as to block fire exit door.

No person shall stand or park a vehicle so as to block a labeled fire exit door which opens into an alley, nor shall a vehicle stand or be parked such as to reduce the egressway to less than four feet between the exit door and a public street. (Ord. 552 § 11, 1993)

10.12.150 No parking within 15 feet of a fire hydrant.

No person shall stand or park a vehicle within 15 feet of a fire hydrant. (RCW 46.61.570(1)(b)(ii)) (Ord. 552 § 12, 1993)

10.12.155 No parking in front of a mailbox.

Drivers may not stop, stand or park vehicles in the right-of-way in front of mailboxes between 8:00 a.m. and 6:00 p.m., except on postal holidays or to avoid conflict with other traffic or in compliance with the directions of a police officer or traffic control device. (Ord. 1092 § 4, 2015)

10.12.160 No parking within 20 feet of a fire station.

No person shall stand or park a vehicle within 20 feet of the driveway entrance to any fire station and on the side of the street opposite the entrance to any fire station within 75 feet when signposted. (RCW 46.61.570(1)(b)(v)) (Ord. 552 § 13, 1993)

10.12.170 No parking within 30 feet of a stop sign.

No person shall stand or park a vehicle within 30 feet upon the approach to any flashing signal, stop sign, yield sign, or traffic control signal located at the side of a roadway. (RCW 46.61.570(1)(b)(iv)) (Ord. 552 § 14, 1993)

10.12.180 No parking within an intersection.

No person shall stop, stand or park a vehicle within an intersection. (RCW 46.61.570(1)(a)(iii)) (Ord. 552 § 15, 1993)

10.12.190 Moving vehicle of another prohibited.

No person shall move a vehicle not lawfully under his control into any area where stopping, standing or parking is prohibited or restricted. (RCW 46.61.570(3)) (Ord. 552 § 16, 1993)

10.12.195 Unlawful avoidance of traffic control device.

10.12.200 No parking in a planted area.

No person shall stop, stand or park a vehicle within a planted area of any street when such area is planted and maintained in a well-defined manner. (Ord. 552 § 17, 1993)

10.12.210 No parking where prohibited by posted signs.

No person shall:

A. Stop, stand or park a vehicle at any place or time where official signs prohibit stopping;

B. Stand or park a vehicle at any place or time where official signs prohibit standing; or

C. Park a vehicle at any place or time where official signs prohibit parking. (Ord. 552 § 18, 1993)

10.12.220 Restricted parking zone.

No person shall stop, stand or park a vehicle in violation of the posted or marked restrictions, unless a valid special placard, card, decal or license plate issued pursuant to RCW 46.19.010 or recognized under RCW 46.19.070 is displayed in a prominent place on the vehicle as provided in RCW 46.19.030 and the posted or marked restrictions are only time limit restrictions. 10.12.230 School loading zone.

No person shall park in a school loading zone except for a reasonable period of time while waiting for passengers. (Ord. 552 § 20, 1993)

10.12.240 Servicing vehicles in street restricted.

No person shall park a vehicle in any street or alley to service such vehicle by supplying such vehicle with gasoline, oil or water, or by changing or renewing the tires thereof; or by washing the same; or by repairing the same in any manner which leaves the vehicle on the street or alley in an inoperable condition; provided, however, that necessary service may be rendered to a vehicle so disabled that the vehicle cannot be operated under its own power or without damage or injury thereto. 10.12.250 No parking on sidewalk.

No person shall stop, stand or park a vehicle on or over a sidewalk, whether constructed or not, or on a street planting strip. (RCW 46.61.570(1)(a)(ii)) (Ord. 552 § 22, 1993)

10.12.260 Tow-away zone.

No person shall stop, stand or park a vehicle within any space signed or marked as a tow-away zone. Besides being cited for a parking infraction, vehicles so parked will be impounded. (Ord. 552 § 23, 1993)

10.12.270 No parking on trails.

No person shall stop, stand or park a vehicle, bicycle or other device on or adjacent to a trail, path, lane or other facility or way which has been designated for use of pedestrians, equestrians or bicyclists, in such a manner as to obstruct or restrict the use of any portion thereof; provided, that authorized emergency and maintenance vehicles are excluded from the provisions of this section when engaged in necessary emergency or maintenance work. 10.12.280 No parking next to wall or fence.

No person shall stand or park a vehicle alongside any wall, fence, or other physical obstructions where there is no sufficient sidewalk for the use of pedestrians or insufficient room to permit persons to exit from the vehicle on the sidewalk side of the vehicle. (Ord. 552 § 25, 1993)

10.12.290 Wrong side parking.

No person shall stop, stand or park a vehicle on that portion of any street or alley lawfully set aside for the parking of vehicles or movement of traffic in the direction opposite to that which the parked vehicle faces. (Ord. 552 § 26, 1993)

10.12.300 Parking at direction of police officer.

10.12.310 Parking notices.

10.12.330 Presumption in reference to illegal parking.

10.12.340 Response to notice within 15 days.

Any person who receives a notice of traffic infraction relating to parking shall respond to such notice as provided in LFPMC 10.12.350 within 15 days of the date of the notice. (RCW 46.63.070) (Ord. 552 § 31, 1993)

10.12.350 Traffic infractions – Adoption by reference.

All sections of Chapter 46.63 RCW (“Disposition of Traffic Infractions”) as now or hereafter amended are adopted by reference as a part of this chapter in all respects as though such sections were set forth herein in full. (Ord. 824 § 5, 2000; Ord. 552 § 32, 1993)

10.12.360 Monetary penalties.

A. Forty-Five-Dollar Penalty Per Offense. It is a civil parking infraction with a monetary penalty of $45.00 for each offense committed in violation of this chapter, unless a higher penalty is specifically provided for under this chapter. Any person who fails to request a hearing to contest the notice of infraction, but who then fails to pay the amount of the penalty prescribed for the infraction within 15 days of the date of the notice in the manner specified on the notice, shall be assessed an additional monetary penalty of $20.00. Any person who fails to pay the amount of the penalty prescribed for the infraction within 30 days of the date of the notice in the manner specified on the notice shall be assessed a second additional penalty of $20.00.

B. Twenty-Five-Dollar FTA Penalty. There shall be a penalty of $25.00 for failure to respond to a notice of traffic infraction relating to parking, or to appear at a requested hearing or to pay a monetary penalty imposed pursuant to this chapter.
