5.15.010 Sewer construction fund.
(1) There is created and established in the office of the Snohomish County Treasurer, as ex officio Treasurer of the District, a special fund to be known as the “sewer construction fund.” Moneys derived from any source for the purpose of paying the cost of carrying out the improvement authorized by the resolution codified in this section shall be deposited in the “sewer construction fund” of the District and shall be used for the sole purpose of paying the cost of carrying out the improvement and of paying the cost and expenses connected therewith. The Lake Stevens Sewer District, through its proper officers and agents, shall proceed with the making of those improvements and the calling of bids therefor in the manner provided by law. Pending the sale of the sewer revenue bonds, the District may issue interest-bearing warrants drawn upon the “sewer construction fund” to be paid out of the proceeds of the sale of the bonds or from other moneys available for that purpose.
(2) In addition to the moneys directed to be deposited into the construction fund of the District by subsection (1) of this section, unless otherwise provided by the Board of Sewer Commissioners, the principal proceeds received by the District from the sale of sewer revenue bonds and all other moneys received by the District for the purpose of acquiring or constructing new sewer facilities, property and appurtenances relating thereto, and all costs and expenses incidental thereto, shall be deposited into the construction fund and be expended only for such purposes. 5.15.020 Construction No. 39 fund.
There is created and established in the office of the Treasurer of Snohomish County, Washington, as ex officio treasurer of the District, a special fund of the District to be known and designated as the “construction No. 39 fund,” and the District shall deposit in such fund the sum of $234,144 received from the Hewlett-Packard Company. 5.15.030 Schedule A fund.
There is created and established in the office of the Snohomish County Treasurer, as ex officio Treasurer of the Lake Stevens Sewer District (the “District”), a special fund to be known as the “construction fund – Schedule A.” Moneys derived from the Hewlett-Packard Company for the purpose of paying the cost for construction of that portion of the waste water treatment plant expansion designated as Schedule A in the District’s contract documents dated March 1984 (i.e., the Hewlett-Packard on-site interceptor) shall be deposited in the construction fund – Schedule A of the District and shall be used for the sole purpose of paying the cost of carrying out the improvements and of paying the cost and expenses connected therewith. 5.15.040 Schedule B fund.
There is created and established in the office of the Snohomish County Treasurer, as ex officio Treasurer of the District, a special fund to be known as the “construction fund – Schedule B.” Moneys derived from the Department of Ecology for the purpose of paying the cost for construction of that portion of the waste water treatment plant expansion designated as Schedule B in the District’s contract documents dated March 1984 shall be deposited in the construction fund – Schedule B of the District and shall be used for the sole purpose of paying the cost of carrying out the improvements and of paying the cost and expenses connected therewith. 5.15.050 Schedule C fund.
There is created and established in the office of the Snohomish County Treasurer, as ex officio Treasurer of the District, a special fund to be known as the “construction fund – Schedule C.” Moneys derived from the Economic Development Administration for the purpose of paying the cost for construction of that portion of the waste water treatment plant expansion designated as Schedule C in the District’s contract documents dated March 1984 shall be deposited in the construction fund – Schedule C of the District and shall be used for the sole purpose of paying the cost of carrying out the improvements and of paying the cost and expenses connected therewith. 5.15.060 Schedule D fund.
There is created and established in the office of the Snohomish County Treasurer, as ex officio Treasurer of the District, a special fund to be known as the “construction fund – Schedule D.” Moneys derived from the Community Economic Revitalization Board for the purpose of paying the cost for construction of that portion of the waste water treatment plant expansion designated as Schedule D in the District’s contract documents dated March 1984 shall be deposited in the construction fund – Schedule D of the District and shall be used for the sole purpose of paying the cost of carrying out the improvements and of paying the cost and expenses connected therewith. 5.15.070 Deposits to construction funds.
Moneys derived from sources other than the sources specified in LSSDC 5.15.030 through 5.15.060 may be deposited in any of the funds established by LSSDC 5.15.030 through 5.15.060 to the extent otherwise permitted by applicable law and regulations and by the terms of applicable grant or loan documents. 5.15.080 Use of construction funds.
Moneys in the funds established by any one of LSSDC 5.15.030 through 5.15.060 may be used for the purpose of paying the cost and expense of improvements described in any of the other sections, or for any other additional improvements in connection with the District’s waste water treatment plant expansion, to the extent otherwise permitted by applicable law and regulations and by the terms of applicable grant or loan documents.
