13.92.010 Right of entry – Generally.

The city engineer, superintendent of the wastewater treatment plant, plumbing inspector, or other duly authorized employee of the city bearing proper credentials and identification shall be permitted to enter all properties for the purpose of inspection, observation, testing, all in accordance with the provisions of Chapters 13.72 through 13.96 LMC. The city engineer or the superintendent of the wastewater treatment plant, plumbing inspector or other duly authorized employee of the city shall have no authority to inquire into any process beyond that point having a direct bearing on the kind and source of discharge to the sewers or waterways or facilities for wastewater treatment. 13.92.020 Safety.

While performing the necessary work on private premises referred to in LMC 13.92.010, the duly authorized city employees shall observe all safety rules applicable to the premises established by the company. [Ord. 1449 § 1 (Exh. A), 2013; Ord. 680 § 702, 1981.]

13.92.030 Right of entry – Easements.

The city engineer, superintendent of the wastewater treatment plant and other duly authorized employees of the city bearing proper credentials and identification shall be permitted to enter all private properties through which the city holds a duly negotiated easement for the purpose of, but not limited to, inspection, observation, measurement, sampling, repair and maintenance of any portion of the sewage works lying within said easement, all subject to the terms, if any, of the agreement.
