*The provisions of this chapter are exempted from the operation of the business and occupation tax, Chapter 5.05 LMC.

5.24.010 License – Required – Exceptions.

It is unlawful for any person or persons, company, corporation or association to keep, manage, run or conduct a place or room in the city in which a billiard or pool table is maintained or operated without first procuring a license therefor, and paying the fee provided for herein; provided, that nothing herein contained shall apply to regularly organized YMCAs, fraternal organizations or associations where such tables are used exclusively by members thereof, or private residences where billiard or pool tables are maintained for the use of the occupants thereof. 5.24.020 License – Fee.

Any person desiring to keep, manage, run or conduct any place or room in the city in which any billiard or pool table is maintained or operated shall pay a license fee as follows:

(1) For each billiard table, $30.00 per year;

(2) For each pool table, $30.00 per year;

(3) For each special tournament event, during which pool or billiard tables are to be used for 10 successive days or less, $2.00 per day for each billiard table or pool table; provided, however, that in no event shall the license fee for any such special tournament or exhibition event be less than $25.00, regardless of the length of such tournament or exhibition event and regardless of the number of billiard tables or pool tables to be used. For purposes of this subsection, a day shall consist of a period of time commencing at 6:00 a.m. and terminating 24 hours thereafter, or any portion thereof. 5.24.040 License – Application – Contents.

No such license referred to in LMC 5.24.010 shall be issued until the applicant files with the city clerk an application on a form to be supplied by the city clerk setting forth:

(1) The true and correct name of the person or persons, company, corporation or association desiring to be licensed;

(2) The exact location of the place or room in which the business is to be conducted, and a drawing, to scale, of said place or room;

(3) The kind and number of tables of each kind to be maintained and operated;

(4) In the event of tournament or other organized pool or billiard play for a period of 10 days or less, the length of time for which such license is requested. (Ord. 1913 § 3, 1978; Ord. 191 § 3, 1928).

5.24.050 Annual licenses – Payable when.

All licenses herein provided for shall be annual, except in the event of special licenses for tournament or related billiard or pool play for a period of time of 10 days or less, and all license fees shall be payable in advance on the first day of each calendar year; provided, that where an application for a license is made after the first day of July of any calendar year, said license shall be for the balance of the calendar year and the license fee shall be one-half of the amount set forth in LMC 5.24.020(1) and (2). 5.24.060 Revocation of license.

Any license issued under and by virtue of the authority of this chapter may be revoked at any time by the city council upon good cause shown and upon such revocation the license shall immediately terminate and expire, but there shall be no refund of the license fee. (Ord. 191 § 5, 1928).

5.24.070 Transfer of license – Permission of council required.

No license issued under and by virtue of this chapter shall be transferred without the consent of the city council. (Ord. 191 § 6, 1928).
