MISCELLANEOUS RULES AND REGULATIONS

11.40.020 Operators in a procession.
Each operator in a funeral or other procession, except a lawful parade, shall drive as near to the right-hand edge of the roadway as practical and shall follow the vehicle ahead as close as is practical and safe. (Ord. 1517 § 31-38, 1971).
11.40.030 Limited backing.
No vehicle shall back into an alley. No vehicle shall back out of an alley except when same is obstructed and an emergency is imminent. (Ord. 1517 § 31-39, 1971).
11.40.070 Placing signs, advertising structures or merchandise for sale on streets and sidewalks prohibited – Promotional activities and activities permitted by Chapter 12.30 LMC excepted.
Except as authorized by Chapter 5.14 LMC and Chapter 12.30 LMC, it is unlawful for any person to store or display any sign or signs, advertising structures, or any goods, wares or merchandise, or any other thing for purposes of display, announcement, advertisement, sale or otherwise on any street, right-of-way, alley or sidewalk, or in the space between the sidewalk and street curbs in the city; provided, however, that the city council, by resolution, may authorize the temporary use of the public streets and sidewalks for the display and sale of goods, wares and merchandise in connection with promotional activities conducted by not less than six retail stores, whose permanent places of business are all contiguous, in connection with an annual merchandise fair with the time, place, exhibitors and exhibits to be fixed by said resolution of the city council; provided further, that where sufficient width exists so as not to interfere with pedestrians, the city council may permit the maintenance of newspaper vending machines in such areas. 11.40.080 Railroad trains not to block streets.
It is unlawful for the directing officer or the operator of any railroad train to direct the operation of or to operate the same in such a manner as to prevent the use of any street or highway within the city limits for purposes of travel for a period of time longer than five minutes; except that this provision shall not apply to trains or cars in motion other than those engaged in switching. (Ord. 1517 § 31-44, 1971).
11.40.090 Persons under 16 operating motorcycles on private property – Unlawful.
It is unlawful for any person under 16 years of age to operate a motorcycle on private property zoned for residential use in the city, unless the operator resides as a permanent resident upon that lot, tract or parcel upon which the motorcycle is being operated.
(1) This section shall not be applicable to a guest of a lawful resident of said lot, tract or parcel who is operating a motorcycle owned by the lawful resident of the lot, tract or parcel;
(2) Property zoned for residential use, as herein used, shall be defined as property zoned residential district R-1, R-2, R-3, R-4 and traditional neighborhood residential, TNR. (Ord. 3122 § 3, 2010; Ord. 1652 § 1, 1973).
11.40.100 Persons under 16 operating motorcycles on private property – Violation – Impoundment.
In the event of the violation of LMC 11.40.090, the police department shall have the right to impound the motorcycle involved in the violation for a period of not less than 72 hours to ascertain and investigate ownership of the vehicle and property involved and to determine the possessory rights therein and the occupants thereof. To secure a release of the motorcycle, the police department shall be entitled to reimbursement for all reasonable expenses incurred impounding the motorcycle and the storage thereof; provided, however, such expenses shall not exceed the sum of $12.00 per vehicle per impoundment. 11.40.110 Gas powered vehicle – Muffling device required.
It is unlawful for any person to operate any gas powered vehicle in the city without an operating muffling device which shall effectively blend the exhaust and motor noise so as to preclude excessive or unusual noise. For the purposes of this section, any noise is excessive which is in excess of 82 decibels on the “A” scale at 100 feet in accordance with the testing procedures established by the Washington State Patrol. (Ord. 1652 § 3, 1973).
11.40.130 Motorcycles on private property and unnecessary vehicle noise – Aiding or abetting violation unlawful.
It is unlawful for any person to aid or abet in the violation of LMC 11.40.090 through 11.40.120. (Ord. 1652 § 5, 1973).
11.40.140 Use of coasters, roller skates and similar devices restricted.
(1) No person upon roller skates, or riding in or by means of any coaster, toy vehicle, or similar device, shall go upon any roadway except while crossing a street on a crosswalk, and when so crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This section shall not apply upon any street during the period such street is set aside for a lawful parade or similar function.
(2) It is unlawful to tow any person upon any device described in subsection (1) behind a motor vehicle within the city limits except at a lawful parade or similar function. (Ord. 1821 § 1, 1977).
11.40.150 Applicability of traffic code to places other than public highways, streets and alleys.
The provisions of RCW 46.52.010, 46.52.020, 46.52.030, 46.52.070, 46.52.090, 46.61.445 and 46.61.500 through 46.61.517 shall be applicable to all motor vehicle operators and all motor vehicles operated on any private roadway open to public use, any private parking area to which the public is invited or permitted, and any publicly owned or maintained place where motor vehicles are allowed to travel.
