OFF-STREET PARKING FACILITIES

11.60.010 Council findings.
The city council finds and declares as follows:
(1) That all economic and physical surveys necessary in determining the need, the practicability, and the feasibility necessary to the establishment of off-street parking facilities have been made, are a part of the official record of the hearing held before the council on July 23, 1970, and are on file in the office of the city clerk;
(2) That a comprehensive plan for the establishment of said off-street parking facilities adequate for such purpose has been prepared and is likewise a part of the official records of said hearing and is on file in the office of the city clerk;
(3) That a public hearing, in accordance with the provisions of RCW 35.86.050, has been duly held at 7:30 p.m., July 23, 1970, in the City Council Chambers, City Hall, Longview, Washington, on said comprehensive plan and the minutes of said hearing also constitute a part of the official record thereof;
(4) That there is a definite need for off-street parking facilities within the downtown business district area of the city. That such facilities should include open surface parking as well as multistory parking facilities, and that said facilities should be constructed on the real property described in LMC 11.60.020;
(5) That the present traffic conditions in the downtown business area of the city create serious traffic congestion and a danger to the public safety and the construction of the off-street parking facilities hereinabove referred to will alleviate such traffic congestion. (Ord. 1482 § 1, 1970).
11.60.020 Plan adopted.
The following plan for the acquisition, construction and maintenance by the city of off-street parking facilities is found and declared to be necessary for public safety, and to be for the public use, and is hereby accepted and adopted:
(1) The city shall acquire the following described real property located in the city:
Lots 1 to 8, inclusive, Block 68, Plat of Longview No. 4.
Lots 5 to 8, inclusive, Block 69, Plat of Longview No. 4.
Lots 9 to 16, inclusive, Block 68, Plat of Longview No. 2.
Lots 9 to 12, inclusive, Block 69, Plat of Longview No. 2.
Lots 12 to 20, inclusive, Block 70, Plat of Longview No. 2.
Lots 3 to 8, inclusive, Block 79, Plat of Longview No. 2.
Lots 1 to 8, inclusive, Block 80, Plat of Longview No. 2.
Lots 1 to 6, inclusive, Block 81, Plat of Longview No. 2.
Lots 1 to 5, inclusive, Block 82, Plat of Longview No. 2.
Lots 11 to 16, inclusive, Block 85, Plat of Longview No. 2.
Lots 9 to 15, inclusive, Block 86, Plat of Longview No. 2.
Lots 12 to 17, inclusive, Block 87, Plat of Longview No. 2.
(2) The city shall construct and install such surface parking areas and multilevel parking structures thereon as are set forth in the comprehensive off-street parking plan on file in the office of the city clerk. Such plan, however, shall be subject to such changes in detail not affecting the main general features thereof as shall be found necessary and desirable by the city council.
(3) The city shall proceed to carry out the plan specified herein at such time or times as found necessary and advisable, and to the best interests of the city and its inhabitants. (Ord. 1482 § 2, 1970).
11.60.030 Financing.
The following plan for the financing of the off-street parking facilities described herein is found to be feasible and economically sound, and such plan for financing is adopted:
(1) The estimated cost of the acquisition, construction and installation of the off-street parking facilities provided for in LMC 11.60.010 through 11.60.040, including all expenses incidental thereto, is hereby declared to be as near as may be the sum of $4,500,000;
(2) The cost of the off-street parking facilities provided in LMC 11.60.010 through 11.60.040 shall be paid from the proceeds of sale of revenue bonds, hereby authorized to be issued by the city in the principal amount of $4,500,000;
(3) Such revenue bonds shall be payable from parking revenues and from assessments in one or more utility local improvement districts to be hereafter created. The assessments levied and the amounts derived therefrom shall be for the sole purpose of payment into a revenue bond fund to be hereafter created by ordinance of the city council for the payment of such revenue bonds.
The exact date, form, terms, maturities, redemption rights and covenants of such revenue bonds shall be as hereafter fixed by ordinance of the city council. (Ord. 1482 § 3, 1970).
11.60.040 Supervision – Fees.
The city shall, through the department of public works, operate, maintain and supervise the off-street parking facilities to be constructed in accordance with LMC 11.60.010 through 11.60.040, and a reasonable and fair charge for the parking of motor vehicles shall hereafter be established by resolution of the city council. 11.60.050 Areas outside comprehensive parking plan.
(1) Off-street parking lots with regulated parking shall be established upon the following described real property, outside the area covered by the comprehensive off-street parking plan, which is owned or leased by the city to provide off-street parking space and facilities for motor vehicles within the city; the real property upon which said parking lots are to be constructed is located within the city of Longview, Cowlitz County, Washington, and is more particularly described as follows:
(a) Properties owned:
(i) Lots 7 and 8, Block 111, Longview No. 1, according to the plat thereof on file in the office of the county auditor,
(ii) Lot 8 and the southeasterly one-half of Lot 9, Block 112, Longview No. 11, according to the plat thereof on file in the office of the county auditor,
(iii) South 45 feet of Lot 2, and Lots 3 through 12, inclusive, Block 78, Longview No. 10, according to the plat thereof on file in the office of the county auditor;
(b) Properties leased:
(i) Lots 1, 2, and 3, Block 98, Longview No. 2, according to the plat thereof on file in the office of the county auditor,
(ii) Lot 14, and the southerly 30 feet of Lot 15, Block 79, Longview No. 2, according to the plat thereof on file in the office of the county auditor.
(2) The off-street parking facilities herein created and established shall be operated by the city and the management and operation thereof shall be conducted under the direction of the city manager.
(3) The method of operation of the off-street parking facilities herein created and established shall be as follows:
(a) Spaces within the off-street parking facilities herein created shall be rented on a monthly basis taking into consideration the availability of other nearby parking facilities and the demand for permanent parking. The monthly rental amount shall be determined by resolution of the city council. To facilitate this provision, the city manager is authorized to provide for the issuance and execution of rental agreements with renters of parking spaces;
(b) For a parking space within the herein created off-street parking facilities, not available for rent on a monthly basis, there shall be installed a parking meter, or such other parking control device, as may be approved. Parking charge shall be made as approved by resolution of the city council. (Ord. 2050 § 1, 1981; Ord. 1579 §§ 1 – 3, 1972).
11.60.060 Application of provisions of Chapter 11.62 LMC.
Off-street parking facilities owned by the city, within the central area, bounded by 16th Avenue, the alley east of 12th Avenue, Washington Way and Florida Street, and not rented on a monthly basis or equipped with parking meters, shall be subject to the provisions of Chapter 11.62 LMC. 11.60.070 Same – Notice of overtime parking – Payment – Penalties.

11.60.080 Records.
Copies of all notices attached to vehicles pursuant to LMC 11.60.070 shall be delivered to the Longview police department. The police department shall keep an accurate record of all such notices, together with the location, date and time of all overtime parking within off-street parking facilities of the city, the make and the state license number of vehicles to which such notices have been attached, and any other facts which may contribute to an understanding of the circumstances attending such overtime parking. 11.60.090 Violation – Misdemeanor.
Repealed by Ord. 2819. (Ord. 1760 § 6, 1975).
