12.16.010 Sign posting prohibited – Exception.

It is unlawful for anyone to place any sign, as defined in MMC 17.08.770, within any city park unless authorized by the city clerk. (Ord. 2094 § 2, 2024; Ord. 759 § 1, 1978).

12.16.020 Defacing park property prohibited.

It is unlawful for anyone to remove or damage any structure, vegetation, lighting system, sprinkling system, or any other property within any city park. (Ord. 2094 § 2, 2024; Ord. 759 § 2, 1978).

12.16.030 Allowing animals at large prohibited.

It is unlawful for anyone to allow any animals to run at large or be on a leash greater than eight feet in length in any city park. (Ord. 2094 § 2, 2024; Ord. 759 § 3, 1978).

12.16.040 Discharging fireworks, firearms or slingshots prohibited.

A. It is unlawful for anyone to discharge any fireworks or explosive of any kind in a city park except for a city-sponsored fireworks display licensed by the Washington State Fire Marshal’s Office.

B. It is unlawful for anyone to carry any firearm or discharge any firearms, including airguns, BB guns, bows, or slingshots in any park within the city; provided, that the restriction herein regarding firearms shall not apply to a lawful peace officer. (Ord. 2094 § 2, 2024; Ord. 759 § 4, 1978).

12.16.050 Feeding, annoying, or killing wildlife prohibited.

It is unlawful for anyone to feed, harass, injure, or kill any fish or wildlife in any city park. (Ord. 2094 § 2, 2024; Ord. 759 § 5, 1978).

12.16.060 Soliciting and other occupations prohibited.

It is unlawful for anyone to solicit, beg, or perform for donations in any city park without a written permit from the city clerk. (Ord. 2094 § 2, 2024; Ord. 759 § 6, 1978).

12.16.070 Permit required for special events.

It is unlawful for anyone to operate or host a special event in a city park without a special event permit from the city clerk as required by Chapter 12.15 MMC. (Ord. 2094 § 2, 2024; Ord. 759 § 7, 1978).

12.16.080 Concession contract required for sales.

It is unlawful for anyone to sell food or merchandise of any kind within a city park without the written permission of or a concession contract with the city. (Ord. 2094 § 2, 2024; Ord. 759 § 8, 1978).

12.16.090 Distributing literature prohibited.

It is unlawful for anyone to distribute literature in a city park. (Ord. 2094 § 2, 2024; Ord. 759 § 9, 1978).

12.16.100 Amplification.

It is unlawful for anyone to operate or use any loudspeaker or mechanical device to amplify sound in a city park, except as permitted during a city-approved event. (Ord. 2094 § 2, 2024; Ord. 759 § 10, 1978).

12.16.105 Inflatable structures.

A. No inflatable structures are allowed within the parks of the city without permission from the city, a signed indemnification agreement between the city and the applicant in a form approved by the city attorney, and proof of liability insurance from the applicant.

B. All inflatable structures permitted under this section must be rented from vendors on the approved Washington State Labor and Industries list. No personally owned inflatable structures are allowed within the parks of the city. (Ord. 2094 § 2, 2024; Ord. 2087 § 1, 2024).

12.16.110 Riding vehicles outside drives prohibited.

It is unlawful for anyone to ride or operate any nonmotorized or motorized vehicle in any city park, except along and upon designated park drives or as part of an authorized event. Walking of nonmotorized vehicles through a city park is not considered a violation. (Ord. 2094 § 2, 2024; Ord. 759 § 11, 1978).

12.16.120 Motor vehicle speed limit – Standing and parking prohibited.

It is unlawful for anyone to operate a motor vehicle in excess of 15 miles per hour within a city park. It is unlawful to park a motor vehicle in a city park outside of the designated parking areas. (Ord. 2094 § 2, 2024; Ord. 759 § 12, 1978).

12.16.130 Riding horses prohibited.

Horses are prohibited within a city park. (Ord. 2094 § 2, 2024; Ord. 759 § 13, 1978).

12.16.140 Camping outside designated areas prohibited.

Repealed by Ord. 2068. (Ord. 759 § 14, 1978).

12.16.150 Depositing refuse prohibited.

It is unlawful for anyone to litter or dispose of refuse matters outside of designated receptacles in a city park. (Ord. 2094 § 2, 2024; Ord. 759 § 15, 1978).

12.16.160 Building fires outside designated areas prohibited.

It is unlawful for anyone to build any fires in a city park except in designated areas as authorized by the mayor or designee and with the approval of the fire department. (Ord. 2094 § 2, 2024; Ord. 1771 § 1, 2011; Ord. 759 § 16, 1978).

12.16.165 Hours.

A. City parks shall be closed from dusk to dawn, unless the city park or facility is fully lit. Fully lit facilities may be used until the lights are turned off, or 10:00 p.m., whichever is earlier. Illuminated sidewalks within a city park may be used between dusk and dawn.

B. City parks shall have signs posted at the entrances of the parks stating operating hours.

C. Any person or persons found to be in a city park during the period of dusk to dawn, except as allowed in subsection A of this section, shall be subject to the penalty as set forth in MMC 12.16.190. 12.16.190 Violation – Penalty.

Any person violating any provision of this chapter shall constitute a misdemeanor and, on conviction thereof, shall be punishable as set forth in Chapter 1.08 MMC. (Ord. 2094 § 2, 2024; Ord. 840 § 2, 1980; Ord. 759 § 19, 1978).
