17.34.010 Purpose.
The purpose of the major public use or MPU district is to provide suitable area for public uses where the types of public uses or the size of the area set aside for public uses warrant a separate zoning district and where the area is definitely committed to public use and is publicly owned. (Ord. 1366 (part), 1995).
17.34.020 Permitted uses.
Permitted uses in the MPU district are as follows:
(1) Public agency offices;
(2) Courthouses and judicial facilities;
(3) Equipment maintenance and storage facilities for public uses;
(4) Police stations and fire stations;
(5) Community centers and public institutions of elementary or secondary education;
(6) Campgrounds, parks and playgrounds;
(7) Playing fields and other publicly owned recreational facilities;
(8) Publicly owned and operated parking facilities appurtenant to above uses;
(9) Cemetery;
(10) Hospital/clinic;
(11) Library; or
(12) Wastewater treatment plant. (Ord. 1366 (part), 1995).
17.34.030 Conditional uses.
Conditional uses in the MPU district are as follows:
(1) Restaurants, taverns or cocktail lounges;
(2) Jails and other correctional facilities;
(3) Guesthouse and caretaker's single-family dwelling, incidental to a permitted use;
(4) Retail/wholesale outlet incidental to permitted use;
(5) Residential care facilities where land and buildings are in public ownership;
(6) Animal shelters;
(7) Agricultural activities;
(8) Dwelling unit contained within a commercial building;
(9) Indoor amusements and entertainment; or
(10) Off-site hazardous waste treatment and storage facility. (Ord. 1366 (part), 1995).
17.34.040 Special conditions.
Special conditions in the MPU district are as follows:
(1) Animals shall be permitted within this district only in conjunction with publicly owned or operated residential care facilities and animal shelters or when such animals are used by law enforcement agencies;
(2) Storage of vehicles and other materials: Section 17.44.029. (Ord. 1366 (part), 1995).
17.34.050 Lot and yard requirements.
Lot and yard requirements in the MPU district are as follows:
(1) Minimum lot size: two thousand five hundred square feet;
(2) Minimum lot width: twenty-five feet;
(3) Minimum yards: as required in the building code except that where side or rear yards are adjacent to a residential district, the required minimum side yard shall be ten feet and the required minimum rear yard shall be twenty-five feet. (Ord. 1366 (part), 1995).
17.34.060 Height and density requirements.
Height and density requirements in the MPU district are as follows:
(1) Maximum building height: three stories and not more than forty-five feet. Greater building height may be allowed through a conditional use permit; provided, that the minimum front, side and rear yard setbacks are increased by one foot for each one foot by which the building exceeds forty-five feet.
(2) Exceptions to height restrictions: Section 17.44.028. (Ord. 1366 (part), 1995).
17.34.070 Sign limitations.
Permitted signs in the MPU district are as follows:
(1) Lighted or unlighted nameplates, not exceeding fifteen square feet in area, identifying public buildings and uses;
(2) Lighted or unlighted on-site bulletin board not exceeding thirty-two square feet in area, and that has no portion within ten feet of any property line; and
(3) Flashing signs shall not be permitted. (Ord. 1366 (part), 1995).
17.34.080 Parking requirements.
Minimum off-street parking in the MPU district shall be minimum of four parking spaces on site for all uses plus one space for each employee. Other parking requirements are as follows:
(1) Public offices, courthouses and judicial facilities, police stations and fire stations: one space per three hundred fifty square feet of gross floor area;
(2) Equipment maintenance facilities for public uses: one space for each employee;
(3) Educational institutions:
(A) Elementary: one space per classroom plus the greatest of one space per administrative employee, one space per four seats, or one space for every eight feet of bench length in the auditorium or assembly room;
(B) Secondary: one space per classroom, plus one space per administrative employee, plus the greatest of one space for every six students, one space for every four seats, or one space for every eight feet in bench length in the main auditorium; and
(4) Jails or other correctional facilities and residential care facilities: one space for every five patient, resident or inmate beds plus one space per employee. (Ord. 1366 (part), 1995).
