10.05.010 Adoption by reference.
The “Washington Model Traffic Ordinance”, Chapter 308-330 WAC, referred to in this chapter as the “MTO”, and RCW 46.90.005 and 46.90.010 are adopted by reference as the traffic ordinance of the City of Mountlake Terrace as is set forth in full, and are adopted as amended in the future as provided in RCW 46.90.010. 10.05.050 Additional authority.
In addition to the Traffic Engineer’s authority which is contained in WAC 308-330-265 section of the MTO, the Traffic Engineer has authority to perform the following actions:
A. Close any highway or part thereof temporarily to any and all vehicular traffic for recreational purposes.
B. Restrict or prohibit on-street parking within sight area triangles as defined in MTMC 19.120.290 in excess of any limitations identified in Washington State Administrative Code. (Ord. 2727 § 1, 2018; Ord. 2045, 1994; Ord. 1155 § 4, 1977).
10.05.060 Fines.
Unless another penalty is expressly provided by law in the MTO or in the statutes that are adopted by reference therein, any person who is convicted of violating or failing to comply with any of the provisions of this chapter shall be punished by a fine of not more than $1,000 or by imprisonment not to exceed 90 days or both. 10.05.070 Copies of statutes adopted.
Washington State statutes and regulations as codified in the Washington Administrative Code (WAC) adopted by reference in this chapter are adopted pursuant to RCW 35A.12.140 as though fully set forth in this chapter as presently constituted or as may be subsequently amended. The statutes, codes, or regulations as codified, so adopted by reference in this chapter, are attached to the ordinance codified in this chapter as Exhibit A and incorporated herein by this reference as if set forth in full. (Ord. 2045, 1994; Ord. 1155 § 6, 1977).
10.05.080 Filing copy of referenced statutes and codes.
Not less than one copy of Exhibit A to the ordinance codified in this chapter containing the statutes, codes, or regulations as codified, in the form in which they were adopted by reference, shall be filed in the office of the City Clerk for use and examination by the public. The “Office of the City Clerk” means those areas within City Hall under the control or access of the City Clerk. (Ord. 2045, 1994; Ord. 1155 § 7, 1977).
10.05.090 Authentication.
The City Clerk shall authenticate the ordinance codified in this chapter by signing on the signature block provided. Exhibit A to the ordinance codified in this chapter shall be separately authenticated by the City, as required by RCW 35A.12.140, by the City Clerk attaching a cover page to Exhibit A labelled “Authentication of Exhibit A” and stating that the statutes, codes, or regulations as codified attached as Exhibit A to the ordinance codified in this chapter are in the form in which they were adopted by reference by the ordinance codified in this chapter. Such cover sheet shall state that such statutes referenced in the statutes, codes, or regulations as codified attached as Exhibit A to the ordinance codified in this chapter are not attached, but are available in City Hall in a copy of the Revised Code of Washington which is available for the use and examination by the public. Authentication of Exhibit A shall be accomplished by the City Clerk signing such cover page to Exhibit A on the signature block provided on such cover page. (Ord. 2045, 1994; Ord. 1155 § 8, 1977).
10.05.100 Recordation.
Recordation of the ordinance codified in this chapter along with Exhibit A to the ordinance codified in this chapter shall be accomplished by the City Clerk noting in the minutes of the City Council meeting adopting the ordinance codified in this chapter that the ordinance was so adopted and that a copy of the ordinance is attached to the minutes along with a copy of Exhibit A to the ordinance. Such copies so attached shall reflect the authentication of the ordinance codified in this chapter and Exhibit A to the ordinance codified in this chapter. (Ord. 2045, 1994; Ord. 1155 § 9, 1977).

10.05.180 Road restrictions.
A. Emergency Load – Road Restriction. The traffic engineer can declare an emergency and thus invoke road restrictions, deemed necessary by road and/or weather conditions, which would or would be likely to damage streets, roads, alleys, or highways, if emergency road limits, speed limits, and/or vehicle restrictions were not immediately placed upon such roadways, streets, alleys, or highways.
B. Truck Route Restriction. Truck routes for trucks weighing more than five tons shall be established on the following streets:
212th St. S.W.: From West City Limit to East City Limit;
215th S.W./216th S.W./61st W.: From West City Limit to 212th St. S.W.;
220th St. S.W.: From West City Limit to 52nd Ave. W.;
228th St. S.W.: From 44th Ave. W. to East City Limit;
236th St. S.W.: From Interstate 5 On-ramp to Cedar Way;
244th St. S.W.: From West City Limit to Cedar Way;
66th Ave. W.: From North City Limit to 220th St. S.W.;
56th Ave. W.: From 220th St. S.W. to 244th St. S.W.;
52nd Ave. W.: From 212th St. S.W. to 220th St. S.W.;
44th/Cedar Way: From 212th St. S.W. to 244th St. S.W.
Operation of through trucks over five tons, except for delivery or moving purposes, on other than designated truck routes shall be penalized according to MTMC 10.05.230. (Ord. 1758, 1987; Ord. 1155 § 17, 1977).
10.05.190 Speed limits.
A. A speed limit of 30 miles per hour is hereby established for motor vehicle traffic upon the following streets, roadways, highways:
52nd Ave. W., between 212th St. S.W. and 220th St. S.W.;
220th St. S.W., from Interstate 5 east to 52nd Ave. W.;
244th St. S.W., west of Cedar Way within the City limits;
236th St. S.W., between 65th Pl. W. and 48th Ave. W.;
228th St. S.W., east of 44th Ave. W. to the City limits;
44th Ave. W., between 212th St. S.W. and 228th St. S.W.;
56th Ave. W., between 220th St. S.W. and 244th St. S.W.;
66th Ave. W., from the north City limits to 232nd St. S.W.
B. A speed limit of 35 miles per hour is hereby established for motor vehicle traffic upon the following streets, roadways, highways:
212th St. S.W., east and west of 44th Ave. W., within the City limits;
220th St. S.W., west of Interstate 5, within the City limits;
Cedar Way, south of 228th St. S.W. within the City limits;
236th St. S.W., between 48th Ave. W., and Cedar Way.
C. A speed limit of 20 miles per hour is hereby established for motor vehicle traffic upon the following streets, roadways, highways:
224th St. S.W., between 56th Ave. W. and 54th Ave. W.;
54th Ave. W., between 223rd St. S.W. and 224th St. S.W.
D. The legal speed limit on all City streets is 25 miles per hour, unless otherwise posted.
The entry terminus of each street, roadway, highway, with a speed limit in excess of 25 miles per hour shall be posted with a sign clearly indicating the established legal speed limit. Advisory signs, indicating a reduced speed zone ahead, near the exit terminus of said street, roadway, highway, shall suffice as regulatory signs. Intersecting streets may be posted, where deemed advisable by the Traffic Engineer, with a sign indicating the legal speed limit on the intersecting streets, roadway, highways.
Intersections and curves may be posted with reduced speed limits where deemed advisable by the Traffic Engineer.
Except as provided above, no other signs or markings relating to speed shall be required on the affected streets, roadways, highways, or on intersecting streets, roadways, highways, for the purpose of conformance and enforcement. (Ord. 1847, 1989; Ord. 1718, 1987; Ord. 1155 § 18, 1977).
10.05.200 Parking.
On-street parking shall be prohibited at the following locations, for which distances from intersections are measured from the prolongation of the face of curb or, if no curb, then from the edge of the roadway of the cross street:
44th Avenue W.
On the east and west side: From 212th to 229th.
Cedar Way
On the east and west side: From 229th to 244th.
48th Avenue W.
On the west side: From 236th to 244th.
On the west side: From 236th to Hedlund Ave.
52nd Avenue W.
On the west side: From 334 feet south of 212th to 212th.
On the west side: From 54 feet north of 213th to 213th.
On the west side: From 54 feet north of 216th to 149 feet south of 216th.
On the west side: From 30 feet north of 218th to 36 feet south of 218th.
On the west side: From 170 feet south of 218th to 258 feet south of 218th.
On the west side: From 146 feet north of 220th to 220th.
On the east side: From 212th to 112 feet south of the centerline of 220th.
56th Avenue W.
On the east side: No parking on pavement from 216th to 75 feet south of 218th.
On the east side: A distance of 800 feet south of 220th to 220th.
On the west side: A distance of 40 feet north of 220th to 220th.
On the east side: From the centerline of 224th St. S.W. to a distance of 73 feet north.
On the west side: From the north driveway of St. Pius parking lot to 20 feet south of the south driveway.
On the east and west side: A distance of 200 feet north of 230th to a distance of 300 feet south of 236th.
On the west side: A distance of 160 feet north of 238th to a distance of 50 feet south of 239th.
On the west side: A distance of 60 feet north and 90 feet south of 239th Pl. S.W.
On the east side: A distance of 50 feet north of 240th St. S.W.
On the east side: A distance of 172 feet north and 75 feet south of the main south entrance driveway located at approximately 241st St. S.W.
On the east and west side: A distance of 300 feet north of 244th to 244th.
57th Avenue W.
On the east side: A distance of 70 feet south of 231st to 231st.
58th Avenue W.
On the west side: Between 220th St. S.W. and 221st St. S.W.
On the east side: A distance of 700 feet south of 220th to 220th, and a distance of 50 feet north of 220th to 220th.
On the east and west side: On Thursdays between noon and 10:00 p.m., when posted, from 240 feet south of 232nd to 232nd.
On the west side: Four hours maximum parking allowed, between the hours of 6:00 a.m. and 5:00 p.m., between the north and south property lines of Jack Long Park, approximately 340 feet.
On the east and west side: A distance of 210 feet north of 212th Pl. S.W.
On the west side: Four hours maximum parking allowed, between the hours of 6:00 a.m. and 5:00 p.m., between the south property line of Veteran’s Memorial Park and the south extension of the south right-of-way line of 234th St. S.W.
On the west side: From 236th St. S.W. a distance of 55 feet south of 236th St. S.W.
On the east side: From 236th St. S.W. a distance of 75 feet south of 236th St. S.W.
60th Avenue W.
On the west side: From 232nd Pl. to 233rd Pl.

On the north side: From west City limits to 61st Pl. W., except for the following: (1) A distance of 100 feet east of the west City limits to the west City limits; and (2) From 75 feet west of 68th to 420 feet east of 68th.
216th Street S.W./216th Place S.W.
On the north side: From 44th Ave. to 238 feet east of 48th Ave.
On the south side: From 48th Ave. to 532 feet east of 48th Ave.
218th Street S.W.
On the north side: From 66th Ave. W. around the curve radius of the west entrance to Lakeside Apartments.
On the south side: Parking shall be limited to a maximum of two hours at any time from 66th Ave. W. to the west entrance of Lakeside Apartments.
219th Street S.W.
On the north and south side: From the southeast entrance of building 1 (6301 219th), Lakeside Apartments, to the intersection with 64th Ave. W. (approximately 180 feet).
220th Street S.W.
On the north and south side: From 52nd Ave. W. to west City limits.
224th Street S.W.
The area located west of 48th Ave. W. from the end of the cul-de-sac, approximately 315 feet west of 48th, westerly to the barricade terminating 224th St. S.W. (approximately 115 feet).
226th Street S.W.
On the north and south side: A distance of 210 feet west of 66th to 66th.
228th Street S.W.
On the north and south side: A distance of 200 feet west of 44th to the east City limits.
On the north side: From 53rd Ave. W. to 55th Ave. W.
On the south side: A distance of 60 feet east of 56th to 56th.

237th Street S.W.
On the south side: From 58th to former Evergreen Elementary School’s property line. No parking north of seven feet south of pavement.
Lakeview Drive
On both sides: From 72nd to the intersection with 236th and 65th.
Except: Those areas designated for parking on the east side of Lakeview Drive north of the entrance to Ballinger Clubhouse.
244th Street S.W.
On the north side: A distance of 300 feet east of 56th to the west City limits.

10.05.260 Amendments.
All amendments to the statutes of the state of Washington incorporated by reference in the preceding sections, whether now in force or hereafter adopted, are hereby incorporated by this reference, and shall be deemed to be a part of this chapter. (Ord. 1155 § 24, 1977).
10.05.265 Avoiding an intersection to turn right or left prohibited.
A. It is unlawful for the driver of a vehicle intending to turn onto another street at an intersection, or at any point, to make or attempt to make a right-hand or left-hand turn by crossing over private property, except where necessary to avoid conflict with other traffic or in compliance with law or the direction of a police officer or traffic-control device.
B. Failure to perform any act required, or the performance of any act prohibited, by this section is a traffic infraction.
C. Any person violating this section shall be guilty of an infraction and subject to a fine of $101.00. (Ord. 2391 § 1, 2005).
10.05.270 Limited access roadways.
Limited access roadways shall be established in the following locations:
A. Cedar Way. Beginning at the intersection at 44th Ave. W. and 228th St. S.W. and extending south to the intersection of Cedar Way and 244th St. S.W.
B. 236th St. S.W. Beginning at the intersection of 236th St. S.W. and Cedar Way and extending west to the intersection of 236th St. S.W. and 48th Ave. W. (Ord. 1353, 1980; Ord. 1155 § 27, 1977).
10.05.280 Cell phone usage – Adoption by reference.
The following RCW sections, as currently enacted or as hereafter amended or recodified from time to time, are hereby adopted by reference and shall be given the same force and effect as if set forth herein in full:
