10.26.010 Assumption of Mukilteo transportation benefit district.

From and after the effective date of the ordinance codified in this chapter, the city of Mukilteo assumes all of the rights, powers, immunities, functions and obligations of the Mukilteo transportation benefit district. The city of Mukilteo is hereby vested with each and every right, power, immunity, function, and obligation granted to or possessed by the Mukilteo transportation benefit district under Chapter 36.73 RCW, this chapter, and/or any other applicable law as of the effective date of the ordinance codified in this chapter. The governing body of the Mukilteo transportation benefit district is abolished and the rights, powers, functions and obligations previously exercised and/or performed by the governing body of the Mukilteo transportation benefit district are vested in the city of Mukilteo city council. 10.26.020 Governing body.

A.    The Mukilteo city council shall be vested with the authority to exercise all statutory powers set forth in Chapter 36.73 RCW and this chapter.

B.    The Mukilteo city council shall implement a material change policy to address major plan changes that affect project delivery or the ability to finance the plan, pursuant to the requirements set forth in RCW 36.73.160(1). At a minimum, if a transportation improvement exceeds its original cost by more than twenty percent, as identified in the district’s original plan, a public hearing shall be held to solicit public comment regarding how the cost change should be resolved. 10.26.030 Functions of the city.

A.    To carry out the purposes of this chapter, and subject to the provisions of Chapter 36.73 RCW, the city is authorized to impose the following taxes, fees, charges, and tolls:

1.    A sales and use tax in accordance with RCW 82.14.0455;

2.    A vehicle fee in accordance with RCW 82.80.140;

3.    A fee or charge in accordance with RCW 36.73.120; and

4.    A property tax as provided in RCW 36.73.060.

B.    The city may authorize and issue general obligation and/or revenue bonds in the manner and subject to the restrictions set forth in RCW 36.73.070.

C.    The city may form a local improvement district and impose assessments therefor and take those actions allowed, and subject to the limitations of RCW 36.73.080.

D.    Additional transportation improvements may be added to the functions of the city upon compliance with Chapter 36.73 RCW.

E.    The city shall have and may exercise all powers and functions provided for by Chapter 36.73 RCW in order to fulfill the purposes of Chapter 36.73 RCW and this chapter. (Ord. 1408 § 4 (Exh. A) (part), 2017)

10.26.040 Transportation improvements funded.

A.    Funds raised by the exercise of powers granted in Section 10.26.030 and/or Chapter 36.73 RCW may be utilized for any lawful purpose under Chapter 36.73 RCW, but all funds raised shall be expended only for the purposes specified.

B.    Funds raised by the exercise of powers granted in Section 10.26.030 and/or Chapter 36.73 RCW will be deposited in the transportation improvement fund as detailed in Chapter 3.117.

C.    Upon authorization by the voters, additional funds from other taxes, fees, charges and tolls or increases in these revenue sources may be utilized for the construction of transportation improvements specifically described in the proposition submitted to the voters.

D.    The funds generated by vehicle fees authorized by the city council in accordance with RCW 82.80.140 shall be used solely for transportation improvements that preserve, maintain and operate the existing transportation infrastructure of the city, consistent with the requirements of Chapter 36.73 RCW. 10.26.050 Annual report to the public.

As required by RCW 36.73.160(2), as the same may be amended from time to time, the city shall issue an annual report, indicating the status of transportation improvement costs, transportation improvement expenditures, revenues, and construction schedules, to the public and to newspapers of record in the district.
