8.04.010 Adoption by reference.
The “Washington Model Traffic Ordinance,” Chapter 308-330 WAC, is adopted by reference as the traffic ordinance of the city as if set forth in full, except as provided in NPMC 8.04.020 of this chapter. (Ord. 589 § 1, 1994).
8.04.020 Sections not adopted.
The following sections of the MTO are not adopted by reference and are expressly deleted: WAC 308-330-210, 308-330-215, 308-330-225, 308-330-230, 308-330-235, 308-330-240, 308-330-245, 308-330-250, 308-330-270, 308-330-275, 308-330-500, 308-330-505, 308-330-510, 308-330-515, 308-330-520, 308-330-525, 308-330-530, 308-330-535, 308-303-540 and 308-330-560. 8.04.022 Parking on roadway.
No person shall stop, park, or leave any vehicle, whether attended or unattended, upon any roadway other than parallel with the edge thereof headed in the direction of lawful traffic movement and with all four wheels off the surfaced portion of the roadway, except as provided below:
(1) The foregoing restriction shall not apply to the driver of any vehicle which is disabled in such a manner and to such an extent that it is necessary to stop and temporarily leave the vehicle in such a location. The driver shall arrange for the prompt removal of the vehicle as required by RCW 46.61.590;
(2) The foregoing restriction shall not apply to the driver of a public transit vehicle or school bus who may temporarily stop such a vehicle upon the roadway for the purpose of receiving or discharging passengers at a marked transit or school bus zone;
(3) The foregoing restriction shall not apply to the driver of any motor vehicle or other equipment that is engaged in work within the right-of-way of any roadway; provided, that such vehicles and equipment shall be marked with warning lights, cones, signs or flashers in such a manner as to warn approaching traffic of their presence.
Parking shall be confined to the curbed side or sides of the street, if any, and sides not posted against parking. (Ord. 969 § 1, 2017; Ord. 390 § 3, 1981).
8.04.023 Stopping, standing, or parking in specified places – Reserving portion of roadway prohibited.
(1) Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic control device, no person shall:
(a) Stop, stand, or park a vehicle:
(i) On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
(ii) On a sidewalk or street planting strip;
(iii) Within an intersection;
(iv) On a crosswalk;
(v) Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless official signs or markings indicate a different no-parking area opposite the ends of a safety zone;
(vi) Alongside or opposite any street excavation or obstruction when stopping, standing, or parking would obstruct traffic;
(vii) Upon any bridge or other elevated structure upon a highway;
(viii) In the area between roadways of a divided highway including crossovers;
(ix) At any place where official signs prohibit stopping;
(x) Within a private lane in such a manner or under such conditions as to leave available less than eight feet of width of the roadway for the free movement of vehicle traffic or in such a position as to block the driveway entrance to any abutting property; or
(xi) In the roadway in front of mailboxes between 8:00 a.m. and 6:00 p.m., except on postal holidays.
(b) Stand or park a vehicle, whether occupied or not, except momentarily to pick up or discharge a passenger or passengers:
(i) In front of a public or private driveway or within five feet of the end of the curb radius leading thereto;
(ii) Within 15 feet of a fire hydrant;
(iii) Within 20 feet of a crosswalk;
(iv) Within 30 feet upon the approach to any flashing signal, stop sign, yield sign, or traffic control signal located at the side of a roadway; or
(v) At any place where official signs prohibit standing.
(c) Park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaged in loading or unloading property or passengers at any place where official signs prohibit parking.
(2) Parking or standing shall be permitted in the manner provided by law at all other places except a time limit may be imposed or parking restricted at other places, but such limitation and restriction shall be by city ordinance or order of the Secretary of Transportation upon highways under their respective jurisdictions.
(3) No person shall move a vehicle not lawfully under his or her control into any such prohibited areas or away from a curb such a distance as is unlawful.
(4) It shall be unlawful for any person to reserve or attempt to reserve any portion of a highway or roadway for the purpose of stopping, standing, or parking to the exclusion of any other like person, nor shall any person be granted such right. (Ord. 1026 § 2, 2021; Ord. 969 § 2, 2017).
8.04.024 Parking longer than 48 hours prohibited.
No person who stops, parks or leaves standing any vehicle in the right-of-way of any roadway in accordance with the Normandy Park Municipal Code shall do so for any continuous period of time in excess of 48 hours. (Ord. 390 § 4, 1981).
8.04.025 Speed limit on First Avenue South.
The maximum lawful speed on First Avenue South between the south city limits at SR 509 milepost 20.48 and the intersection of First Avenue South and SW 174th Street at SR 509 milepost 23.47 shall be 35 miles per hour. Signs shall be posted advising the public of this maximum speed limit. Violation of this maximum speed limit is a traffic infraction punishable as provided in the Model Traffic Ordinance. (Ord. 915 § 1, 2015).
8.04.040 Disposition of traffic fines and forfeitures.
All fines or forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violation of any of the provisions of this chapter shall be paid into the general fund of the city. Traffic safety education penalty assessments pursuant to RCW 46.81.030 and any other penalty assessments shall, however, be deposited as required by law. (Ord. 330 § 4, 1979).
8.04.050 Review of statutory changes.
The city council shall review any repeal, adoption, or amendment of any section of the MTO by the State Legislature at the first regular meeting of the council following receipt of notice of such repeal, adoption, or amendment. (Ord. 330 § 5, 1978).
8.04.060 Official misconduct.
Failure, refusal, or neglect on the part of any judicial or other officer or employee receiving or having custody of any such fine or forfeiture of bail, either before or after a deposit in the general fund, to comply with the provisions of NPMC 8.04.040 shall constitute misconduct in office and shall be grounds for removal therefrom, provided appropriate removal action is taken pursuant to state law relating to removal of public officials. (Ord. 330 § 6, 1978).
8.04.070 Filing.
Incident to the adoption of the MTO by reference by this chapter, copies of the text of the adopted statutes shall be filed as required by RCW 35A.12.140 and 35A.13.180 for use and examination by the public. (Ord. 883 § 9, 2012; Ord. 330 § 7, 1978).
8.04.080 Driver inattention.
No person shall operate a motor vehicle in an inattentive manner over and along the streets, alleys, or ways open to the public of this city. For the purpose of this section, “inattentive manner” means such a manner so as to fail to maintain a careful lookout for persons or property which results in a collision with any person or property. Driver inattention is a traffic infraction. (Ord. 464 § 1, 1986).
8.04.090 Fire lanes.
Stopping, standing or parking of a motor vehicle in a fire lane is prohibited and subject to a penalty of $38.00 each day the violation continues. A vehicle parked in a fire lane may be impounded without prior notification to its owner. (Ord. 777 § 1, 2006).
8.04.100 Restricted parking.
The city manager may, from time to time, designate areas within the city for restricted parking. Restricted parking may include restrictions on the length of time that a vehicle may be parked and restrictions on the types of vehicles that may be parked, such as “employee parking” or “police vehicles only.” Following the erection of signs designating a restricted parking area, no person shall stop, stand, or park a vehicle in violation of the posted restrictions. 8.04.110 Penalty.
Any person violating any section of this chapter shall have committed a civil infraction and shall pay a penalty in the amount of $75.00. (Ord. 969 § 4, 2017).
