2.36.010 Classification of police chief.

The position of police chief shall not be subject to civil service. (Ord. 984 § 1, 1994; Ord. 304 § 1, 1971; Ord. 282 § 1, 1970).

2.36.020 Full-time employees defined.

Full-time employees for the purposes of RCW 11.26.030 are those personnel who will be or have been appointed to the above designated ranks and who regularly or have regularly worked more than 35 hours per week for a period of more than six consecutive months and are in categories (1) through and including (6) in OHMC 2.36.010. (Ord. 282 § 2, 1970).

2.36.030 Police chief – Appointment.

The department of police shall be under the direction and control of the police chief subject to the direction of the mayor or the mayor’s designee. The chief of police shall be appointed by the mayor and confirmed by the city council.

The police chief shall serve at the pleasure of the mayor pursuant to an employment contract proposed by the mayor and approved by the city council. (Ord. 1628 § 4, 2012; Ord. 984 § 2, 1994; Ord. 649 § 1, 1983).

2.36.040 Police chief – Duties.

The police chief shall be the chief law enforcement officer for the city and shall faithfully enforce all laws and preserve the peace. The police chief shall:

(1) Arrest a person violating the laws and ordinances;

(2) Be in charge of the city jail and persons therein;

(3) Assist in the prosecution of all matters in municipal court;

(4) Keep all necessary records and provide reports as required by law, ordinance or direction of city council;

(5) Execute and return all process issued and directed to the police chief by lawful authority;

(6) Suppress any riot, public tumult, disturbance of the peace or resistance against the laws or the public authority in the lawful exercise of their functions. In carrying out such actions, the police chief shall have the same authority as conferred upon sheriffs and shall be entitled to the same protection;

(7) Be responsible for control and direction of search and rescue operations with the city; and

(8) Such other duties as are imposed upon the police chief by law, ordinance or common law.

In accordance with law and ordinance, the police chief may delegate performance of the specific duties assigned in this section, together with the necessary power to carry out the tasks assigned. (Ord. 649 § 2, 1983).

2.36.050 Police chief – Authority.

(1) In carrying out the duties specified in OHMC 2.36.040, the police chief shall have all reasonable authority necessary to carry out the duties imposed and allowed by state or federal law.

(2) All lawful orders of the police chief shall be promptly executed by police officers, members of the police reserve and other personnel of the police department.

(3) Every citizen shall lend his aid to the police chief or police officer when required for arrest of offenders and maintenance of public order.

(4) The police chief may authorize the appointment of a police officer for a one-day period of time.

(5) The police chief or duly appointed police officer may pursue and arrest violators of city ordinances outside the city limits.

(6) The police chief may issue regulations for the internal operation of the police department. (Ord. 649 § 3, 1983).
