ANTICIPATORY OFFENSES

7.02.010  Attempt.

A. A person is guilty of an attempt to commit an offense if, with intent to commit a specific offense prohibited by this code, he does any act which is a substantial step toward the commission of that offense.

B. If the conduct in which a person engages constitutes an attempt to commit an offense, it is no defense to a prosecution of such an attempt that the offense charged to have been attempted was, under the attendant circumstances, factually or legally impossible of commission.

C. Any attempt to commit an offense is a:

1. Class B offense when the offense attempted is a Class A offense;

2. Class C offense when the offense attempted is a Class B or Class C offense.

7.02.020  Solicitation.

A. A person is guilty of solicitation to commit an offense when, with intent to promote or facilitate the commission of an offense, he offers to give money or other thing of value to another to engage in specific conduct which is prohibited as an offense by this code or which would establish complicity of such other person in its commission or attempted commission had such offense been attempted or committed.

B. Solicitation shall be punished in the same manner as an attempt under Section 7.02.010.
