13.17.010 Adoption of Ecology Stormwater Manual.
The city council accepts, approves, specifies, certifies, adopts and incorporates by reference the development regulation set forth in the 2005 Stormwater Management Manual for Western Washington prepared by the Washington Department of Ecology (the “Ecology Stormwater Manual”) as the stormwater regulations for development within the city. All persons within the city shall be required to comply with the provisions of the Ecology Stormwater Manual that are applicable to locations with the hydraulic, geologic, and built-environment features of Ocean Shores. 13.17.020 Interpretation and application of Ecology Stormwater Manual—Dispute resolution.
All questions or disputes regarding the applicability or interpretation of the provisions of the Ecology Stormwater Manual shall be resolved by the mayor or his or her designee. Any appeal from the decision of the mayor shall be to the city hearing examiner. (Ord. 986 § 1, 2016: Ord. 743 § 2.1 (part), 2002)
13.17.030 Adoption of additional regulations.
The council may by ordinance adopt such further regulations as it deems appropriate. (Ord. 986 § 2, 2016: Ord. 743 § 2.1 (part), 2002)
13.17.040 Copies on file.
A copy of the stormwater regulations adopted in Section 13.17.010 are now and shall remain on file in the office of the city clerk. (Ord. 743 § 2.1 (part), 2002)
13.17.050 Permits—Plan approval required.
A grading/fill permit, building permit, or other development permit may not be issued for any parcel or lot unless compliance with this chapter has been approved by the public works director or designee. The approved documentation shall become part of the permit and be enforced as an element of any development permit issued by the city. (Ord. 986 § 3, 2016)
13.17.060 Plan approval—Conditions.
In granting the plan approval, the public works director or designee may impose such conditions thereto as may be deemed necessary to ensure compliance with the provisions of this chapter and the preservation of public health and safety. Any grading/filling permit, building permit, or other development permit issued by the city may be suspended or revoked, after written notice is given to the permittee, for any violations of the approved compliance documentation. 13.17.070 Nonpermitted uses of the storm drainage system.
A. No one may discharge or cause to be discharged any materials of any kind into the storm drainage system, except natural rainfall, clean groundwater, or potable water. This prohibition includes, but is not limited to, water with chlorine concentrations of 0.1 ppm or greater and contaminants in runoff from impervious areas on a parcel unless such discharge is through an approved treatment device.
B. This prohibition does not include discharges from emergency fire fighting activities or nonstormwater discharges covered by another National Pollutant Discharge Elimination System (NPDES) permit, provided the discharger is in full compliance with all requirements of the permit.
C. Except as provided in this section, no person shall use the stormwater system, directly or indirectly, to dispose of any solid or liquid matter other than specifically authorized herein. No person shall make or allow any connection to the stormwater system which could result in the discharge of polluting matter. Connections to the stormwater system from the interiors of structures are prohibited. Connections to the stormwater system for any purpose other than to convey stormwater or groundwater are prohibited and shall be eliminated.
D. The installation or maintenance of any cross connection, meaning a connection between any storm and surface water drainage system and any sanitary sewer system, is prohibited.

13.17.080 Connection to the storm drainage system.
A. No work shall be performed which results in runoff from a parcel to the storm drainage system except under the conditions specified in the required plan approval, as provided in the manual, or herein.
B. Where the connection involves construction of physical facilities such as pipes, inlets, channels, ditches, or other similar improvements, all work shall be inspected and approved by the department of public works prior to acceptance of the work and prior to any occupancy of development on a parcel.

13.17.090 Violation—Penalties.
A. Any person, firm or corporation violating any of the provisions of this code shall be deemed guilty of a Class B offense as defined in Title 7. Each day the violation continues shall be a separate offense.
B. As a separate and concurrent remedy, any person who violates or fails to comply with the following sections of this chapter shall be liable to the city for the actual expense of cleanup or required maintenance.
