REGULATION OF CONSTRUCTION HOURS

15.50.010 Construction hours regulated.

No construction activity shall be permitted within one thousand feet of any residence between the hours of seven p.m. to seven a.m., Monday through Friday, and seven p.m. to nine a.m. weekends, and federal, state or city observed holidays. The city council may grant exemptions from the prohibition set forth in this section for:

A.    Public works projects and other projects within the public rights-of-way for which the mayor and/or their designee determines that the public benefit of night-time construction outweighs the short-term impacts of such construction; and/or

B.    Large scale commercial projects may also apply for an exemption which the mayor and/or their designee may grant if they find that the benefits of reducing the overall construction schedule and/or the additional benefits to the city from sales and use tax revenue from the project outweigh the short-term inconvenience to neighboring residents.

15.50.020 Public nuisance.

All construction activities undertaken in violation of the prohibitions set forth in Section 15.50.010 are declared to be a public nuisance. (Ord. 1103 § 1, 2023)

15.50.030 Penalties.

Any violation(s) of this chapter which occurs during a twelve-month period is a civil infraction under Section 7.01.060, and holds the following monetary penalties for civil infractions committed within the city of Ocean Shores:

A.    First offense shall be a Class 4 civil infraction with a maximum penalty of twenty-five dollars, not including statutory assessments.

B.    Second offense shall be a Class 3 civil infraction with a maximum penalty of fifty dollars, not including statutory assessments.

C.    Third offense shall be a Class 2 civil infraction with a maximum penalty of one hundred twenty-five dollars, not including statutory assessments.

D.    Fourth offense shall be a Class 1 civil infraction with a maximum penalty of two hundred fifty dollars, not including statutory assessments.
