Article I. Running at Large
6.08.010 Unlawful.
It is unlawful for any cow, calf, steer or other variety of neat cattle, or any horse, mule, sheep, goat or pig, to run at large within the limits of the city. (Ord. 63 § 1, 1915)
6.08.020 Penalty for permitting.
Any person having the ownership or the charge, care, custody or keeping of any cow, calf, steer or other variety of neat cattle, or any horse, colt, mule, sheep, goat or pig, who permits the same to run at large within the city limits, is guilty of a misdemeanor and upon conviction thereof shall be fined not less than $1.00 nor more than $100.00, and in default in the payment of such fine and the costs of prosecution, shall be imprisoned in the jail of the city until such fine and costs are paid, but not exceeding 90 days. 6.08.030 Seizure – Sale.
Any cow, calf, steer or any other variety of neat cattle or any horse, mule, sheep, goat or pig, found at large within the limits of the city, may be seized by the authorities of the city and impounded. Any officer or other person making such seizure shall be allowed a fee of $2.00 for making such seizure. The city shall have a lien upon any such animal seized, for the fees of such seizure, and all the costs and expenses of keeping such animal so seized. The lien shall be the same as the lien of agistors or stable keepers in this state. After any such animal has been held for three days the city may proceed to foreclose its lien on any such animal so seized in the same manner as stable keepers or agistors foreclose liens on animals in this state, except that it shall be necessary to give the owner three days’ notice of the time and place of such sale by delivering a copy of such notice to the owner, or in case personal service cannot be had, by publishing the notice in a newspaper of general circulation in the county, three days before such sale. Article II. Keeping
6.08.040 Definitions.
As used in this article:
A. “Livestock” means any horses, mules, sheep, goats, cows, hogs, poultry and rabbits.
B. “Person” means firms, corporations, associations, partnerships, societies and individuals.
C. “Residence” means any building or part of a building used for the purpose of human habitation or dwelling. (Ord. 264 § 1, 1955)
6.08.050 Compliance required.
It shall be unlawful for any person or persons to keep or maintain livestock within the city limits except as provided in this article. (Ord. 264 § 2, 1955)
6.08.060 Enclosure.
All livestock shall be kept within an enclosure adequately built and maintained to prevent the livestock from breaking through, out or over or under the same. (Ord. 264 § 3, 1955)
6.08.070 Poultry and rabbits.
All livestock except hogs, goats, sheep, mules, horses and cows may be kept or maintained within the city limits; provided, that they are kept within an enclosure as described in OMC 6.08.060, the outside limits of which shall not be less than 50 feet from the nearest residence, not including the owner’s, except with the written permission of affected property owners, such permission to be filed at the office of the city clerk-treasurer. In the case of the keeping of any such livestock at the time of the passage of the ordinance codified in this article such consent shall be filed within 30 days. (Ord. 264 § 4, 1955)
6.08.080 Hogs, goats, sheep, horses, mules and cows.
Hogs, goat, sheep, horses, mules and cows may be kept or maintained within the city limits; provided they are kept within an enclosure as described in OMC 6.08.060 and the outside limit of which shall be not less than 100 feet from the nearest residence, not including that of the owner. 6.08.090 Maintenance.
All such buildings, stables, pens or enclosures shall be cleaned of manure or other refuse at least twice each week, and such manure or refuse shall be placed in flyproof containers until disposed of in such a manner approved by the city health officer. Enclosures, barns and pens must be sprayed weekly with an adequate insecticide, from April 1st until October 31st each year. Grounds shall be limed as needed to control odors. (Ord. 264 § 6, 1955)
6.08.100 Violation – Penalty.
Any person violating this article is guilty of a misdemeanor and shall be punished by a fine of not exceeding $100.00 for each separate offense. (Ord. 264 § 7, 1955)
6.08.110 Violation – Separate offenses.
Each and every day on which a violation of this article occurs and continues shall be considered a separate offense. (Ord. 264 § 8, 1955)
