8.20.010 Litter defined.

“Litter,” as used in this chapter, means and includes refuse, rubbish, garbage, waste paper and all other waste material of every kind and description. (Ord. 325 § 1, 1962)

8.20.020 Disposal of litter.

It is unlawful to place, throw, deposit or otherwise dispose of litter in any public place, public park or waters or watercourses, or on any public street or alley, within the city limits, except in garbage cans or in securely tied bundles when such garbage cans and bundles meet the requirements of the city garbage collection ordinance, or in public or private litter receptacles, when provided or approved by the city. 8.20.030 Arrest.

Whenever any person is arrested for any violation of this chapter committed in the presence of the arresting officer, such officer may serve upon such person a citation and notice to appear in the police court, and such person, in order to secure his release, and when permitted by the arresting officer, may give his written promise to appear in such court as required by the citation and notice served by such officer. If such arrested person fails or refuses to sign such promise, he shall be taken into custody by such arresting officer. (Ord. 325 § 3, 1962)

8.20.040 Failure to appear as promised.

Any person who fails to comply with his written promise to appear, in accordance with OMC 8.20.030, shall be subject to arrest and prosecution as a separate offense under this chapter, regardless of the disposition of the charge on which he was originally arrested. (Ord. 325 § 4, 1962)

8.20.050 Violation – Penalty.

Any violation of, or failure to comply with, any provision of this chapter shall subject the offender, upon conviction thereof, to a fine of not more than $100.00 or by imprisonment in the city jail for a period not to exceed 10 days, or by both such fine and imprisonment. (Ord. 325 § 5, 1962)
