3.24.010 Purpose.

The purpose of this chapter is to establish an emergency services organization and program in Okanogan County, in accordance with Chapter 38.52 RCW and other applicable laws. (Ord. 84-2 § 1, 1984).

3.24.020 Definitions.

The definition of “emergency services” and of other terms defined in RCW 38.52.010 are incorporated by reference as though fully set forth herein. (Ord. 84-2 § 2, 1984).

3.24.030 Created – Operation.

There is created a local organization for emergency services to be composed of participating incorporated cities and towns and Okanogan County.

A. If a political subdivision declines to participate in said emergency services organization or declines to contribute its fair and equitable share to said organization, then in accordance with RCW 38.52.070(1) it is directed by said statute to establish its own emergency services organization and comply with Chapter 38.52 RCW in its operation.

B. The operation of said organization shall be conducted through the county administrative offices. There is created and established a special pooled fund to be administered by the treasurer of the county, which fund shall be known as the “Okanogan County emergency services fund” into which shall be deposited all funds received for the account of this organization. All disbursements will be made by warrant drawn against this fund in the manner prescribed by law.

C. All costs of supporting the emergency services organization shall be shared equitably between its constituent members, according to a formula based on their relative populations and relative budgets and as determined by the emergency services council, established in this section.

D. Contributions for normal operating expenses and administration shall be determined annually, included in the participating members’ annual budgets, to be paid no later than May 31st of each year. An annual budget shall be provided by the director, established in OCC 3.24.050, subject to the approval of the emergency services council, for adoption by the county commissioners.

E. Said organization may accept gifts, grants or loans of money, equipment or services from any lawful source and perform all functions authorized by law to be performed by departments of emergency services.

F. Said organization shall honor all previous agreements entered into separately by its participating members prior to the establishment of said emergency services within a reasonable time after notice thereof.

G. Any expenditures made in connection with emergency services activities shall be deemed conclusively to be for the direct protection and benefit of the inhabitants and property of the county and the participating cities and towns. (Ord. 84-2 § 3, 1984).

3.24.040 Adoption of interlocal agreements.

The provisions of the joint local agency agreement (hereinafter known as agreement), executed and adopted by the county commissioners on November 15, 1983, and executed by the mayors of participating cities and towns in the county, are adopted and incorporated by reference herein. Any amendments or revisions to this agreement are likewise adopted and incorporated by reference in this chapter. (Ord. 84-2 § 4, 1984).

3.24.050 Director.

The director of emergency services appointed by the emergency services council shall have direct responsibility for the organization, administration and operation of the local organization, subject to the direction and control of the council. (Ord. 84-2 § 5, 1984).

3.24.060 Withdrawal of membership – Cancellation.

Any member of the organization may withdraw from membership in the same manner withdrawal from membership is authorized under the agreement. Cancellation by the county shall constitute cancellation of this chapter in its entirety and to all parties. This chapter shall continue in effect until canceled. (Ord. 84-2 § 6, 1984).
