8.26.010 Adoption of state statute.

Chapter 17.10 RCW, and any amendments thereto, is adopted and incorporated by reference in this chapter as though fully set forth herein. A violation of Chapter 17.10 RCW is declared to be a violation of this chapter. (Ord. 84-4 § 1, 1984).

8.26.020 Unlawful transport – Gypsophila.

It is unlawful for any person to knowingly transport, haul, carry, cart or ship the noxious weed known as gypsophila (also known as baby’s breath) in a vehicle upon the public highways of the county without having said noxious weed fully enclosed within said vehicle or fully covered with a suitable material, to prevent the spread of the noxious weeds or parts thereof. (Ord. 84-4 § 2, 1984).

8.26.030 Transport or disposal of hay containing noxious weeds.

It is unlawful for any person to knowingly transport, convey, sell or dispose of hay containing any viable noxious weed seed in sufficient amounts to create a hazard of the spread of any noxious weeds; or for any person to knowingly transport, convey, sell or dispose of hay containing any noxious weed in sufficient amounts to be injurious to the health of domestic animals that may consume it. 8.26.040 Prohibited amounts of seed or weed.

The Okanogan County noxious weed control board shall adopt rules and regulations establishing the amount of any noxious weed seed or noxious weed, for each noxious weed on the county noxious weed list, that will constitute a violation of OCC 8.26.030. (Ord. 84-4 § 4, 1984).

8.26.045 Costs of abatement a lien against property.

A. Any lien created pursuant to Chapter 17.10 RCW for control work performed at the direction of the Okanogan County noxious weed control board shall be collected by the Okanogan County treasurer in the same manner as delinquent real property taxes; provided, that within 30 days from the date the property owner is sent notice of the lien, including the amount thereof, the lien remains unpaid and a timely appeal has not been made pursuant to RCW 17.10.180.

B. Such liens treated as delinquent taxes shall bear interest at the rate of 12 percent per annum, which interest shall accrue as of the date notice of the lien is sent to the owner.

C. Any pre-existing liens created under Chapter 17.10 RCW shall also be collected by the Okanogan County treasurer as provided in this section.

D. The collection method as provided in this section shall not be the exclusive method for collecting such lien, or for collecting the expenses underlying the creation of such liens from the property owner. (Res. 12-86, 1986).

8.26.050 Violation – Penalty.

A violation of OCC 8.26.020 or 8.26.030 shall constitute a misdemeanor, punishable by a maximum fine not to exceed $100.00 per violation. (Ord. 84-4 § 5, 1984).
