9.70.010 - Exclusion Orders
A. Exclusion Orders, which prohibit persons from entering or remaining in specified areas of Olympia, may be issued by the Olympia Municipal Court to anyone charged with or convicted of any offense under the Olympia Municipal Code, as a condition of pre-trial release or as a condition of sentence.
B. Whenever a police officer shall have probable cause to believe that any person named in an exclusion order is violating or failing to comply with any term or condition of that exclusion order, such officer may arrest the violator without warrant or other process.
C. A person is deemed to have notice of the exclusion order when:
1. The signature of the person named in the order is affixed to the order; or
2. The order recites that the person named in the order appeared in person before the court and was informed of the content of the order.
D. The exclusion order shall be in writing, shall contain language warning the person named in the exclusion order to not enter or remain in specified areas of Olympia, and shall bear the legend: "Violation of this order is a criminal offense under OMC 9.70.010 and will subject the violator to arrest."
E. It is unlawful for any person named in an exclusion order and with notice of such order to violate or fail to comply with any term or condition of such order. A violation of this subsection is a misdemeanor punishable by a maximum sentence of 90 days in jail and $1,000 fine.
