2.12.010 Bonds or insurance required.
A. Each of the following city officials or employees of the city shall, within thirty days after the effective date of the ordinance codified in this section, and thereafter before any new official or employee assumes the duties of his respective office, give an official bond issued by a surety company licensed to conduct business in the state of Washington, conditioned for the faithful performance of his official duties in the following amounts:
1. City clerk: fifty thousand dollars.
2. Finance director: fifty thousand dollars.
3. Chief of police: fifty thousand dollars.
4. Any other official or employee for whom a bond is required by law: fifty thousand dollars.
B. The requirements of subsection A of this section shall be satisfied if the city of Prosser purchases a blanket bond or bonds to cover the officials of the city or if the city purchases insurance coverage which provides the same or better coverage as would a blanket bond or bonds.
C. All costs for bonds or insurance coverage as required in this chapter shall be paid for by the city.
D. The mayor and city council shall examine the bonds or proof of insurance coverage at the second regular city council meeting of each year to determine compliance with this chapter.
E. If any section, sentence, clause or phrase of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this chapter. 2.12.020 Bonds—Office deemed vacant when not provided.
If any person elected or appointed to any office neglects or refuses to give a bond, as herein required, within ten days after his election or appointment to such office, his office shall be deemed vacant. (Ord. 6 § 2, 1899).
2.12.030 Bonds—Approval and filing required.
The bond provided in Section 2.12.010 shall be approved by the mayor and filed with the clerk, except the bond of the clerk, which shall be approved by the mayor and filed with the mayor. (Ord. 1661 § 1, 1993: Ord. 6 § 3, 1899).
