6.04.010 New buildings for housing animals—Construction prohibited where.

It is unlawful from and after December 6, 1916, for any person, firm or corporation to erect or cause to be erected, within the limits of the city, any barn, corral, pigsty or any place for the housing or keeping of animals or fowl, within a distance of fifty feet from the residence of any person within the city other than the person proposing to erect such barn or structure. (Ord. 231 § 1, 1916).

6.04.020 Existing buildings—Restrictions.

It is unlawful for any person, firm or corporation whether as owner, lessee or occupant of any premises within the city, from and after December 6, 1916, to use any barn, corral, pigsty, hen house or other structure which is, as of December 6, 1916, within a distance of fifty feet of the bona fide residence of any person other than the one thus occupying such barn or other structure, within the limits of the city; provided, this section shall not apply to said structures when built, which adjoin to an alley and do not extend twenty feet therefrom. (Ord. 231 § 2, 1916).

6.04.040 Violation of Section 6.04.010 or 6.04.020 deemed nuisance—Penalty.

Every act or thing done, allowed or continued in violation of Sections 6.04.010 or 6.04.020 of this chapter is deemed and is declared to be a nuisance, and any person who shall fail to abate such nuisance within ten days after notice by the city health officer to abate such nuisance, and any person who violates any of the terms of Sections 6.04.010 or 6.04.020 of this chapter shall be guilty of a misdemeanor and upon conviction thereof shall be punishable as set forth in Section 1.28.010 of this code.
