10.04.010 Short title.

This chapter may be known and cited as the “traffic ordinance.” (Ord. 3213 § 4, 2023).

10.04.020 Washington Model Traffic Ordinance adopted.

The Washington Model Traffic Ordinance, Chapter 308-330 WAC, as now codified or hereafter amended, is adopted by reference as the traffic ordinance of the city of Prosser as if set forth, except for the following sections:

10.04.030 Emergency response caused by person’s intoxication—Recovery of costs from convicted person.

A person whose intoxication causes an incident resulting in an appropriate emergency response, and who, in connection with the incident, has been found guilty of or has had their prosecution deferred for (A) driving while under the influence of intoxicating liquor or any drug, RCW 46.61.502; (B) operating an aircraft under the influence of intoxicants or drugs, RCW 47.68.220; (C) use of a vessel while under the influence of alcohol or drugs, RCW 79A.60.040; (D) vehicular homicide while under the influence of intoxicating liquor or any drug, RCW 46.61.520(1)(a); or (E) vehicular assault while under the influence of intoxicating liquor or any drug, RCW 46.61.522(1)(b), shall pay to the Prosser police department the sum of three hundred fifty dollars per incident. This expense shall be assessed and collected at time of sentencing or entry of a deferred prosecution program. (Ord. 3213 § 6, 2023).

10.04.040 Traffic engineer.

The public works director, or his or her designee, shall be designated the traffic engineer of the city of Prosser. (Ord. 3213 § 7, 2023).

10.04.050 Traffic engineer authorized.

The traffic engineer is authorized to adopt all traffic revisions; angle parking locations; one-way city streets; prohibit, regulate, or limit stopping, standing, or parking of vehicles on any city street at all times or during such times as shall be indicated by official traffic control devices; determine and declare parking meter zones upon those city streets or parts thereof where the installation of parking meters will be necessary to regulate parking; close any city street or part thereof temporarily to any or all traffic; which otherwise require a resolution of the city council pursuant to WAC 308-330-270, as existing or hereinafter amended, on behalf of the city council. 10.04.100 Angle parking—Special restrictions.

A.    Angle parking within the city of any vehicle having an overall length of twenty-two feet or more is prohibited.

B.    Any violation of this section shall constitute a parking infraction with monetary penalties in the amount of fifty dollars plus state assessments. (Ord. 3213 § 9, 2023).

10.04.110 Parking prohibited and restricted in residential zones.

A.    It is unlawful for any person to park or leave standing in any residential zone of the city of Prosser any tractor-trailer truck; semi-truck; gasoline, oil or fuel tanker truck; or chemical tanker truck, except for the purpose of loading or unloading the cargo of such truck and then only for such a period of time as is reasonably necessary to load or unload the cargo.

B.    It is unlawful for any person to park or leave standing on the public roadway in any residential zone of the city any park trailer, travel trailer, motor home, camper, boat, trailer or any vehicle exceeding six thousand pounds empty scale weight for a period of more than seven days in any continuous thirty-day period commencing on the first day that the vehicle is left standing or parked on the public roadway. It is not a defense to a violation of a section if the park trailer, travel trailer, motor home, camper, boat, trailer or any vehicle exceeding six thousand pounds empty scale weight was not continuously parked for twenty-four hours in any day.

C.    Any violation of this section shall constitute a traffic infraction with monetary penalties in the amount of fifty dollars plus state assessments. (Ord. 3213 § 10, 2023).

10.04.120 Parking not to obstruct traffic.

A.    No person shall stop, stand, or park a vehicle within an alley in such position as to block the driveway entrance to any abutting property.

B.    Any violation of this section shall constitute a parking infraction with monetary penalties in the amount of fifty dollars plus state assessments. (Ord. 3213 § 11, 2023).

10.04.990 Severability.

If any section, subsection, sentence, clause, paragraph, phrase, or word of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the validity or constitutionality of any other section, subsection, sentence, clause, paragraph, phrase or word of this chapter.
