10.05.010 Use of engine brakes.

The use of engine brakes, exhaust brakes, or other device which performs the same function as this equipment is hereby prohibited within the city limits of the city of Prosser, Washington. Unmuffled exhausts, as described and set forth in RCW 46.37.390, are prohibited. It shall be an affirmative defense to prosecution under this section that compression brakes were applied in an emergency and were necessary for the protection of persons and/or property. Further, this section shall not apply to any emergency vehicle when responding to an emergency. (Ord. 2529 § 2 (part), 2005).

10.05.020 Signage.

The city shall install, or cause the installation of, signs prohibiting the use of engine brakes and unmuffled exhausts within the city at the entrances to the city where use of such equipment has been noted. The public works director shall cause the placement of additional signs within the city at such locations as will provide notice that such use of engine brakes is prohibited. (Ord. 2529 § 2 (part), 2005).

10.05.030 Penalty.

The violation of this prohibitory chapter shall be deemed a civil infraction. Each infraction of such chapter shall carry a civil penalty of two hundred fifty dollars. (Ord. 2529 § 2 (part), 2005).

10.05.900 Severability.

The provisions of this chapter are hereby declared to be severable. If any section, subsection, sentence, clause, or phrase of this chapter or its application to any person or circumstance is for any reason held to be invalid or unconstitutional, the remainder of this chapter shall not as a result of said section, subsection, sentence, clause, or phrase be held unconstitutional or invalid.
