6.10.010 Public nuisance declared.
Weeds, grass and other vegetation higher than 12 inches may be declared a public nuisance upon a determination by the fire chief or his/her designee that such vegetation growth is either a fire hazard or a menace to the public health, safety and welfare. Upon declaration of such nuisance, the owner of the property or the person responsible may be required to abate the nuisance as set forth below in PMC 6.10.020. (Ord. 2547 § 1, 1998; Ord. 2091 § 2, 1986).
6.10.020 Abatement procedure.
Upon declaration by the fire chief or his/her designee of a nuisance pursuant to this chapter, the fire chief or his/her designee shall follow the notice and abatement procedures pursuant to PMC 6.08.235, 6.08.236, 6.08.237 and 6.08.238, directing the abatement of such nuisance. All references to “community development director” in PMC 6.08.235, 6.08.236, 6.08.237 and 6.08.238 shall be deemed to be “fire chief” for the purposes of notice and abatement procedures pursuant to this chapter. 6.10.030 Violation and infraction.
In addition to any other penalty or remedy available, violation of any provision of this chapter shall constitute a Class 1 civil infraction as defined in Chapter 1.02 PMC. Any act of a continuing nature as prohibited in this chapter shall be considered a separate offense for each day that the infraction occurs. (Ord. 2547 § 1, 1998; Ord. 2091 § 2, 1986).
