10.16.010 Model Traffic Ordinance – Adopted.
The “Washington Model Traffic Ordinance,” Chapter 308-330 WAC as hereinafter referred to as “MTO,” and RCW 46.16.160 (unlawful use of trip permits), 46.20.205 (failure to notify Olympia of address and name change), Sections 4, 5, 6, 7, 8, 9, 10, 11, 12, and 23 of Chapter 275, Laws of 1994 (relating to the 1994 Omnibus Drunk Driving Act) and RCW 46.20.730, as amended by Section 23 of Chapter 275, as the same have previously been amended or shall in the future be amended, are adopted by reference as and for the traffic ordinance of the city as if set forth in full in this chapter, except as provided in PMC 10.16.020. 10.16.015 Additional statutes adopted.
In addition to the MTO, the following sections of the Revised Code of Washington are adopted by reference as currently enacted or as amended hereafter:

38.52.430 Emergency response caused by person’s intoxication – Recovery of costs from convicted persons.

10.16.020 Model Traffic Ordinance – Deletions.
The following sections of the MTO are not adopted by reference and are expressly deleted: WAC 308-330-275, WAC 308-330-600 through 308-330-660, and WAC 308-330-555 inclusive. (Ord. 3069 § 1, 2014; Ord. 2402 § 5, 1994; Ord. 1995 § 2, 1983; Ord. 1796 § 2, 1980).
10.16.030 Violation – Penalty.
Unless another penalty is expressly provided by law in the MTO or in the statutes that are adopted by reference therein, any person who is convicted of violating or failing to comply with any of the provisions of this chapter shall be punished by a fine of not more than $500.00, by imprisonment not to exceed 90 days, or both. (Ord. 1796 § 3, 1980).
10.16.040 Filing of copies.
Incident to the adoption of the MTO by reference, by this chapter, copies of the text of the adopted MTO and other adopted statutes shall be filed as required by RCW 35.21.180. (Ord. 1796 § 4, 1980).
10.16.050 Street closure authorized.
The city manager or his designee is authorized to close any public street within the city when it is determined that an emergency exists affecting the public health and safety of the city and its residents. (Ord. 1880 § 1, 1981).
