17.42.010 Code adopted by reference.

There are adopted by reference upon the effective date of the ordinance codified in this chapter the standards hereafter set forth. A copy of each of the city codes has been placed on file in the office of the city clerk. Future amendments to the standards established hereafter shall automatically become a part of this section upon publication:

(1) City Standards for Public Works Engineering and Construction.

(2) Standard Specifications for Roads, Bridges, and Municipal Construction published by the Washington State Department of Transportation and American Public Works Association. The version in effect will be the most current version approved for city use by the public works director.

(3) Stormwater Management Manual for Western Washington, published by the Washington State Department of Ecology, as presently constituted or as may be amended, updated, supplemented, or revised. The version in effect will be the most current version approved for city use by the council. (Ord. 3130 § 1 (Exh. A), 2016; Ord. 2376 § 3, 1993).

17.42.020 Conflict of standards.

In case of conflict between codes enumerated in PMC 17.42.010, the first named code shall govern. (Ord. 2376 § 3, 1993).

17.42.030 Applicability of standards.

The provisions of this chapter and the City Standards for Public Works Engineering and Construction and the Standard Specifications for Roads, Bridges, and Municipal Construction, and Stormwater Management Manual for Western Washington shall be applicable to and govern in the following cases:

(1) Contracts for public improvements awarded by the city in all cases except those cases in which a federal or state master contract shall be in conflict with the City Standards for Public Works Engineering and Construction, the Standard Specifications for Roads, Bridges, and Municipal Construction, or with the Stormwater Management Manual for Western Washington, and in such cases the provisions of the particular federal or state contract shall govern and shall be binding upon the city and the contractor;

(2) Contracts for any public improvements within the public right-of-way, easements, and city properties;

(3) Operations of any public improvements within the public right-of-way, easements and city properties;

(4) Projects on private property, relating to utilities, which are connected to the basic city utility system, or include storm water facilities constructed on private property. (Ord. 3130 § 1 (Exh. A), 2016; Ord. 2376 § 3, 1993).

17.42.032 Issuance of approvals or permits.

This section provides authority for the city engineer to designate combined permit application, review, and issuance, of permits authorized under each section designated below. The issuance of combined permits shall coordinate the expiration date of the combination permits to the same date as the building permit to which it is issued. All bonding, surety, insurance or assignment of funds shall be maintained in good standing; if good standing is not maintained the permit shall be null and void until revised.

17.42.035 Expiration of applications, approvals or permits.

(1) Expiration of Application. Project applications that are subject to SEPA review shall be governed by applicable SEPA deadlines. All other applications shall expire by limitation if no permit or approval is issued within 180 days after the city determines that the application is complete, unless the city determines that a project proponent has pursued issuance of a permit or approval in good faith. The city may extend the time for action on the application for one or more periods, each period not exceeding 90 days, upon written request by the applicant showing good cause. If an application has expired, plans and other data previously submitted for review may thereafter be returned to the applicant, except that the city shall retain originals or copies in order to comply with applicable record retention laws. In order to renew action on an expired application, the applicant shall resubmit plans and pay a new review or application fee.

(2) Expiration of Permits or Approvals. All permits or approvals shall expire by limitation and become void if:

(a) Work authorized by the permit or approval is not commenced within 180 days of approval or permit issuance;

(b) Work is suspended or abandoned for 180 days or more after work is commenced; or

(c) After two years from the date of permit or approval issuance, regardless of whether work is finished.

The city engineer or designee is authorized to grant one or more extensions of time for periods not more than 180 days each. The extensions shall be requested in writing and justifiable cause demonstrated.

If a permit or approval expires, the city may issue a new permit or approval for the unfinished work upon a showing of good cause and payment by the project proponent of half of the original permit or approval fee. However, if any applicable law, regulation or rule has materially changed after the expiration of the permit or approval, the city shall have full discretion to decline to issue a new permit even upon a showing of good cause. The option for approval or permit renewal shall lapse two years after the permit or approval expires.

(3) This section shall apply to permits and approvals issued under PMC Titles 11, 14 and 21, and applications for such permits or approvals. (Ord. 3043 § 7, 2013; Ord. 2962 § 7, 2010).

17.42.040 City Standards for Public Works Engineering and Construction manual.

The City Standards for Public Works Engineering and Construction manual has been prepared to provide a graphic and written representation of minimum standards for construction of public improvement within the public right-of-way, easement, city properties, and on private property relating to utilities which are connected to the utility systems maintained by the city of Puyallup. The application of the city standards has been coordinated with the Standard Specifications for Road, Bridge, and Municipal Construction prepared by the Washington State Department of Transportation and the American Public Works Association. Revisions to the City Standards for Public Works Engineering and Construction or additional specifications may be prepared from time to time by the engineering division, and shall become a part of this chapter. A copy of the “City Standards for Public Works Engineering and Construction” is on file in the office of the city engineer. (Ord. 3130 § 1 (Exh. A), 2016; Ord. 2376 § 3, 1993).
