2.16.010 Finding.

The City has established a municipal department of the Grant County District Court pursuant to RCW Chapter 3.46. The City is required to provide by ordinance for the appointment of the judges of the District Court to serve as judges of the City’s municipal department. (Ord 07-200 §2, Ord 810 §1, 1991)

2.16.020 Appointment of municipal court judges.

The Mayor shall appoint one or more of the currently elected or appointed District Court judges and their pro tems as the part-time municipal judge or judges. (Ord 07-200 §2, Ord 810 §1, 1991)

2.16.030 Term and removal.

Any Municipal Court judge appointed by the Mayor shall serve in such capacity for his or her term as District Court judge and may be removed from so serving in the same manner and for the same reasons as he or she may be removed from the office of District Court judge. 2.16.040 Term independent of Mayor.

Any Municipal Court judge appointed by the Mayor pursuant to this chapter shall remain a Municipal Court judge for the duration of his or her District Court term, despite any change in the status of the appointing Mayor. (Ord 07-200 §2, Ord 810 §1, 1991)

2.16.050 Assessment of court costs.

Whenever, in any criminal or quasi-criminal proceeding to enforce any provision of the Code, the Municipal Court judge finds the defendant, or defendants, guilty after trial or plea of guilty, the Municipal Court judge, in addition to any penalty imposed for the ordinance violation, shall assess the costs as a part of the sentence imposed for the filing of the cause, the service of subpoenas and the service of arrest warrants, as charged by the Grant County Superior Court; and the cost of the travel of police officers of the City, at the per mile amount allowed by the Internal Revenue Code for transportation costs, in the course of serving the warrant or subpoena. The cost assessed under Section 2.16.050, when collected by the Municipal Court judge, shall be delivered to the Finance Director to be paid into the City’s current expense fund. These costs shall not be suspended by the Municipal Court judge, except when the defendant is indigent. (Ord 24-620 §5; Ord 07-200 §2, Ord 810 §1, 1991)
