A. Pursuant to Chapters 35.68 and 38.70 RCW, the Council directs the Planning Commission, in conjunction with the Public Works Department, to arrange for a survey of all areas within the City that the Planning Commission designates as needing sidewalks. From the results of that survey, the Planning Commission shall prepare a proposed master plan for sidewalk improvements. That proposed master plan for sidewalk improvements shall designate:
1. Any area where sidewalks are to be constructed immediately together with a proposed allocation of the costs of such construction; and
2. Any areas where sidewalks are intended to be constructed and a proposed schedule of construction.
B. The proposed master plan for sidewalk improvements shall be submitted to the Council for adoption. The Council may direct the Planning Commission to resubmit the master plan for sidewalk improvements to the Council after making changes as directed by the Council. Upon the Council’s adoption of the master plan for sidewalk improvements, that plan shall become the City’s sidewalk improvement plan until updated or amended.
C. At least annually, the Planning Commission shall review and revise the master plan for sidewalk improvements and submit such revisions to the council for adoption as the City’s official sidewalk improvement plan in the same manner as the original plan was adopted.
D. If any master plan for sidewalk improvements requires the immediate construction of sidewalks, the Council shall proceed to accomplish such construction pursuant to the laws of the state.
E. If any master plan for sidewalk improvements designates areas for the construction of sidewalks at a later date, the construction shall be accomplished pursuant to the certification procedure defined in Section 15.44.011, or after Council action to amend the master plan for sidewalk improvements to change the timing of the construction from future to immediate, the Council shall proceed to accomplish such construction pursuant to the laws of the state. 15.44.011 Prerequisite for permits. Revised 1/24
A. No building permit for any construction valued at twenty thousand dollars or more shall hereafter be granted unless the applicant or owner of the property where the construction is proposed to be located shall have first obtained a sidewalk installation compliance certificate from the Public Works Department. Such certificate shall be issued only if the applicant or owner has installed required sidewalks, curbs and gutters, or has included said structures as part of the construction project for which the building permit is sought. If the property in question is not subject to the master plan for sidewalk improvements, a certification to that effect shall be issued as a condition precedent to the issuance of a building permit as stated above. Such certification does not preclude sidewalk, curb and gutter improvements from being required at a later date.
B. This section shall not apply to any area within the City that is now or may later be zoned and classified as "manufacturing – zone M." In zone M areas, there shall be no requirement whatsoever for sidewalks.
C. The Council may consider, in its discretion, upon recommendation of the Public Works Department, authorizing the issuance of a sidewalk installation compliance certificate exempting the property from the revised master plan for sidewalk improvements upon a showing by a preponderance of the evidence that sidewalk, gutter, curb or driveway installation is impracticable or unforeseeable due to engineering conflicts caused by existing street grades not in conformance with standard design criteria. 15.44.020 Plans and specifications. Revised 1/24
Plans for the construction of sidewalks or sidewalks and curbs and gutters required by this chapter shall be submitted to the Building Official as part of the plans submitted for obtaining a building permit. Grades for the construction of the improvements required by this chapter shall be established by the Municipal Services Director or by the approval of plans and grades furnished by the owner. All sidewalks, driveways, curbs and gutters required by this chapter shall be constructed in accordance with the City of Quincy Design and Construction Standards; with the most recent Standard Specifications for Road, Bridge, and Municipal Construction as prepared by the Washington State Department of Transportation and the Washington State Chapter of the American Public Works Association. Openings for driveways for ingress and egress from the property shall be approved by the Municipal Services Director. (Ord 23-602 §3 (Ex B); Ord 19-538 §23; Ord 681 §2, 1985)
15.44.030 Construction of curb ramps. Revised 1/24
Whenever the construction of sidewalks is required pursuant to Sections 15.44.005, 15.44.011 and 15.44.020, not less than two curb ramps per lineal block shall be constructed on or near the crosswalks at intersections or other convenient locations. Said ramps shall be in accordance with the City of Quincy Design and Construction Standards and shall comply with the ADA requirements. (Ord 23-602 §3 (Ex B); Ord 748 §3, 1988: Ord 681 §3, 1985)
