RECREATIONAL VEHICLE PARKS

20.39.020 Purpose.
The intent of this chapter shall be to ensure that recreational vehicle parks are located and developed and occupied in accordance with standards and regulations which will protect the health, safety, general welfare and convenience of the occupants of such parks and the citizens of the City. 20.39.030 Zone intent.
Recreational vehicle parks may be allowed in Business (B-D) or Light Industrial (L-I) zones. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C))
20.39.040 General requirements.
A. Size of Vehicle Spaces. Each recreational vehicle space shall have a minimum width of twenty (20) feet.
B. Private Access Streets. Streets within the park shall be hard surfaced to minimum City standards and have a minimum pavement width of twenty four (24) feet measured between pavement edges.
C. Park Entrances and Exits.
1. Access entrances and exits to the park shall be designed for safe and convenient movement of traffic into and out of the park and to minimize friction with free movement of traffic on adjacent streets.
2. All traffic into and out of the park shall be through such entrances and exits.
3. No entrance shall require a turn at an acute angle for vehicles moving in the direction intended.
4. Radii of curbs and pavements at intersections shall be such as to facilitate easy turning and movements for vehicles with trailers attached.
5. No material impediment to visibility shall be created or maintained which obscures the view of an approaching driver in the right lane of the street within one hundred feet of the intersection with the park entrance.
D. Water Supply.
1. A water supply system shall be provided in the recreational park for each recreational vehicle space designed to accommodate the park user occupying a self-contained recreational vehicle or a dependent recreational vehicle and shall be connected to a public water supply system.
2. The water system for a recreational vehicle park shall be constructed and maintained in accordance with all applicable state and local codes and regulations.
3. Each recreational vehicle park shall be provided with one or more easily accessible water supply outlets for filling recreational vehicle water storage tanks.
E. Restroom Facilities. Restroom facilities containing showers and toilets connected to the City’s sewer utility will be provided at a ratio of two toilets, two lavatories, and one shower for every three recreational vehicle spaces. Where the number of spaces is not divisible by three the fraction shall be rounded up. The minimum number in any park of two toilets, two lavatories and one shower for each gender.
F. Sewage Disposal System.
1. An adequate and safe sewage disposal system shall be provided for each recreational vehicle space designed to accommodate the park user occupying a self-contained or dependent recreational vehicle and shall be connected to a public sewer system.
2. The sewage system shall be constructed and maintained in accordance with all applicable state and local codes and regulations.
G. Sanitary Dumping Stations.
1. Sanitary dumping stations in the ratio of one for every one hundred recreational vehicle spaces or fractional part thereof shall be provided.
2. Sanitary stations shall consist of at least:
i a trapped four-inch sewer riser pipe connected to the sewage disposal system and surrounded at the inlet end by a concrete apron sloped to the drain and provided with a suitable hinged cover; and
ii a water outlet, with necessary appurtenances connected to the water supply system to permit periodic wash down of the immediate adjacent areas.
3. The water supply to the flushing device shall be protected from back flow by means of a listed vacuum breaker or back flow prevention devise located down-stream from the last shutoff valve.
4. Posted adjacent to the flushing arrangement shall be a sign of durable material, not less than two feet by two feet in size and inscribed in clearly legible letters shall be: "DANGER – NOT TO BE USED FOR DRINKING OR DOMESTIC PURPOSES."
5. Sanitary stations shall be screened from other activities by a visual barrier such as fence, wall or natural growth and shall be separated from any recreational vehicle space by a distance of not less than fifty feet.
H. Solid Waste Disposal.
1. The storage, collection and disposal of solid waste in the park shall be so conducted as to create no health hazards, rodent harborage, insect breeding areas or accident of fire hazards.
2. Refuse containers for solid waste in adequate quantity shall be rented from and serviced by the City’s sold waste department.
3. Park refuse shall be collected daily by park personnel and placed in the central collection site. Park personnel shall also maintain the park free of any uncontrolled garbage.
I. Other Utility Systems. If other utility systems such as natural gas, television cable, or telephone are installed in a recreational vehicle par, such installation shall be underground in accordance with state and local codes and regulations.
J. Electrical Supply System. Each recreational vehicle park shall be provided with an underground electrical system which shall be installed and maintained in accordance with all applicable state and local codes and regulations.
K. Dog Provisions.
1. Dogs shall be required to be housed in a humane manner, in appropriate dog runs, pens, or owner’s vehicle while left by their owner.
2. Dogs shall be on secure leashes or restraints while not housed in a pen, run, or owner’s vehicle.
3. Dog excrement must be removed from spaces and any common areas of the park on a daily basis.
4. Owners must control continuous barking of their dogs for an extended period of time after ten p.m. and prior to seven a.m. or the dog must be removed from the park by the operator.
L. Numbered Spaces. All recreational vehicle spaces shall be well marked and numbered in accordance with the requirements of the building official, fire chief and police chief.
M. Prohibited Uses.
1. No recreational vehicle shall be occupied for residential or commercial purposes anywhere in the City except as regulated by this title or in the case of conditional uses as regulated by the Zoning Code.
2. No recreational vehicle shall be occupied over night within the City unless the same is parked inside an approved recreational park.
3. No recreational vehicle shall be used as a permanent place of abode, or dwelling, for indefinite periods of time. Occupancy in a park for more than one hundred and twenty days in any twelve-month period shall be conclusively deemed to be permanent occupancy. Any action toward removal of wheels of a recreational vehicle, except for temporary purposes of repair or placement is prohibited.
4. No external appurtenances, such as carports, cabanas, decks or patios may be attached to any recreational vehicle while it is in a park.
5. No spaces within a recreational vehicle park shall be rented for any purpose other than those expressly allowed by this chapter.
N. Size of Park. The minimum size of the recreational vehicle park shall be one acre.
O. Setbacks.
1. The minimum public roadway setback shall be 20 feet.
2. The minimum private roadway setback shall be 5 feet.
3. The minimum residential zone setback shall be 45 feet.
P. Structure Separation.
1. There shall be a minimum side-to-side separation of eight feet between units.
2. There shall be a minimum end-to-end separation of ten feet between units.
Q. Vehicle Site Size. The minimum vehicle site size shall be not less than one thousand (1,000) square feet of land area.
R. Vehicles Per Park. The number of recreational vehicles permitted in a Recreational Vehicle Park shall not exceed a density of twenty (20) units per gross acre. The agency issuing the permit may limit the density further to ensure compatibility with the surrounding areas.
S. Pedestrian Walkways. Pedestrian walkways having a width of not less than five feet shall be provided from private access streets to all service buildings and facilities, refuse collection areas, and recreational areas. The walkways shall be hard surfaced, well-drained and well lighted, and otherwise constructed to the standard of sidewalks. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C))
20.39.050 License requirement.
Every recreational vehicle park shall obtain from the City, a license to do business effective from January 1 through December 31. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C))
20.39.060 Preliminary site plan and associated documents.
The application for approval of a recreational vehicle park shall be in the form of a preliminary site plan and shall include the following:
A. Preliminary Site Plan. A Preliminary Site Plan, which includes the following:
1. All information required on preliminary plat under the Subdivision Code.
2. The number of recreational vehicles to be accommodated.
B. Project Description. A written explanation of the design concept, planned features of the park, measures taken to meet the purposes of this chapter, the proposed sequence and timing of development, operation or maintenance of the Planned Area Development. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C))
20.39.070 Final site plan and associated documents.
Following final approval of the recreational vehicle park conditional use but before development activities commence on the property, the owner shall submit the following:
A. Final Site Plan. A Final Site Plan which includes the following:
1. All elements of the preliminary site plan.
2. All information required on a Final Plat under the Subdivision Code.
B. Endorsements on Final Site Plan. The Final Site Plan shall include all endorsements required on a Final Plat under the Subdivision Code. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C))
20.39.080 Required certificates and approval.
Final Site Plans shall include all of the certificates required for a Final Plat for a Subdivision under the Subdivision Code. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C))
20.39.090 Recording required.
The Final Site Plan that is approved by the City, together with the accompanying documents, and the covenants running with the land, which binds the site to development in accordance with all terms and conditions of approval shall be recorded by the developer with the Grant County Auditor within thirty (30) days of final approval. 20.39.100 Expiration.
A Final Site Plan shall expire unless construction is complete within three years from the date of approval, subject to extension, as set out in Chapter 19.12. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C.
20.39.110 Park administration.
A. Development and Maintenance. The owner of the recreational vehicle park shall be responsible for the development and maintenance of said park in strict conformity with the recreational park conditional uses, the final site plan and all applicable laws and ordinances.
B. Internal Rules and Regulations. The park shall have internal rules and regulations governing the maintenance of the park. (Ord 06-186 (Ex A); Ord 01-86 §5 (Ex C))
20.39.120 Completion prior to occupancy.
All required improvements and other conditions of the recreational vehicle park conditional uses and final site plan approval shall be met prior to occupancy of any site by a recreational vehicle; provided, that completion may be accomplished in phases if approved by the Hearing Examiner. 20.39.130 Compliance.
Any use of land which requires a recreational vehicle park conditional use and final site plan approval, as provided in this chapter, and for which such review and approval is not obtained, or which fails to conform to an approved recreational vehicle park conditional use and final site plan, constitutes a violation of this chapter.
