5-27-010 ESTABLISHING TRANSPORTATION BENEFIT DISTRICT:

There is hereby created Renton Transportation Benefit District (RTBD) with geographical boundaries comprised of the existing corporate limits of the City, and as those boundaries may be adjusted in the future. (Ord. 6115, 8-21-23; Ord. 6121, 10-9-23)

5-27-020 TRANSPORTATION BENEFIT DISTRICT ASSUMED:

The rights, powers, immunities, functions and obligations of RTBD are assumed by the City of Renton which is vested with every right, power, immunity, function and obligation granted to and possessed by the RTBD. (Ord. 6115, 8-21-23; Ord. 6121, 10-9-23)

5-27-030 POWERS OF THE DISTRICT:

A.    The City of Renton shall have and may exercise any powers set out in chapter 36.73 RCW to fulfill the purpose of the RTBD.

B.    Consistent with RCW 36.73.020(4), the secretary/treasurer of RTBD shall be the City Finance Administrator. As such, the Finance Administrator shall establish those funds and accounts on behalf of RTBD as required and shall disburse funds and pay claims as approved by the RTBD Board and prepare and maintain such accounts either as appropriate or required by state or federal law or both.

C.    The City Attorney will serve as legal advisor to the RTBD Board, except where separate counsel is engaged by RTBD.

D.    Other City employees shall carry out the operations of RTBD as agreed by RTBD and the City. Such employees and the contracts of RTBD shall be overseen and administrated either by the Mayor or the Mayor’s designee or both.

E.    The RTBD Board shall develop a material change policy to address major plan changes that affect project delivery or the ability to finance the plan, pursuant to the requirements set forth in RCW 36.73.160(1). At a minimum, if a transportation improvement exceeds its original cost by more than twenty percent (20%), as identified in the District’s original plan, a public hearing shall be held to solicit public comment regarding how the cost change should be resolved.

F.    The RTBD Board shall issue an annual report, pursuant to the requirements of RCW 36.73.160(2). (Ord. 6115, 8-21-23; Ord. 6121, 10-9-23)

5-27-035 ADDITIONAL SALES AND USE TAX FOR RENTON TRANSPORTATION BENEFIT DISTRICT:

A.    Pursuant to RCW 36.73.065 and RCW 82.14.0455, there is hereby imposed an additional sales and use tax to be collected from persons who are taxable by the state under Chapters 82.08 and 82.12 RCW upon the occurrence of any taxable event within the Renton Transportation Benefit District. The amount of the additional tax shall be one-tenth of one percent (0.1%) of the selling price, in the case of the sales tax, or the value of the article used, in the case of the use tax.

B.    The tax imposed by this section shall apply for a period of ten (10) years from the date the tax is first collected within the District and shall thereafter cease to be imposed unless renewed with the affirmative vote of the voters voting at an election or a majority vote of the Renton City Council exercising its authority as the governing body of the district.

C.    The tax imposed by this Section shall be in addition to any other taxes authorized by law, including but not limited to, the sales and use taxes by other Sections of the Renton Municipal Code.

D.    The revenues received from the tax imposed by this Section shall be general revenues of the District and shall be used for those purposes set forth in RMC 5-27-040 or as otherwise authorized by law. (Ord. 6129, 12-11-23)

5-27-040 USE OF FUNDS:

Funds available to the RTBD may be used for any purpose allowed by chapter 36.73 RCW with emphasis on meeting the unfunded needs of the City’s Overlay Program and Walkway Program within the currently adopted Six Year Transportation Program. (Ord. 6115, 8-21-23; Ord. 6121, 10-9-23)

5-27-050 DISSOLUTION OF THE DISTRICT:

The district shall be dissolved when all indebtedness of the district is retired and when all the district’s anticipated responsibilities have been satisfied. (Ord. 6115, 8-21-23; Ord. 6121, 10-9-23)
