DISPOSAL OF JUDICIALLY FORFEITED FIREARMS

6.34.010 Purpose.
The purpose of this chapter is to provide for the disposal of judicially forfeited firearms that come into the possession of the Ritzville city police. (Ord. 890 § 1, 1994).
6.34.020 Disposal procedures.
All firearms that have come into the possession of the police of the city of Ritzville after June 30, 1993, and that are judicially forfeited under RCW 9.41.098 and that are no longer needed for evidence or are forfeited for failure to make a claim under RCW 63.32.010 or 63.40.010 may be disposed of by the police of the city of Ritzville in their discretion as follows:
A. Retained for city police use;
B. Traded to commercial sellers;
C. Auctioned to commercial sellers; or
D. Destroyed. (Ord. 890 § 2, 1994).
6.34.030 Certain firearms not to be retained for agency use or destroyed.
All firearms that are antiques as defined by RCW 9.41.150 or recognized as curios, relics and firearms of particular historic significance by the bureau of alcohol, tobacco and firearms or any successor agency shall not be retained for agency use or destroyed. (Ord. 890 § 3, 1994).
6.34.040 Disposal of firearms which are illegal to possess.
A. All firearms that are illegal to possess, as defined in subsection (B) of this section, shall be destroyed and shall not be retained, traded or auctioned. If firearms, otherwise illegal to possess, may be rendered legal to possess by removal or alteration of component parts, the city police may, in their discretion, effect such removal or alteration and may thereafter dispose of the firearm under RCC 6.34.020.
B. “Firearms that are illegal to possess” means firearms that are illegal to possess as a private citizen under the state or federal law. (Ord. 890 §§ 4, 5, 1994).
6.34.050 Proceeds from trade or auction.
Any proceeds from the trade or auction of firearms shall be used by the city police of the city of Ritzville. (Ord. 890 § 6, 1994).
