SIDEWALK CONSTRUCTION – PERMIT

7.32.040 Grade approval and inspection.
7.32.010 Permit required.
It shall be unlawful for any person, firm or corporation either as owner, agent, lessee, contractor or sub-contractor to erect or construct any sidewalk or curb upon or along any of the public streets of the city of Ritzville except in the manner and upon the terms and conditions herein set forth. (Ord. 512 § 1, 1966).
7.32.020 Application.
Any person, firm or corporation hereinafter desiring to construct and sidewalk or curb upon or along any of the public streets of the city of Ritzville, shall file in the office of the city clerk/treasurer an application in writing. Said application shall set forth the name of the street or streets upon or along which it is desired to construct said sidewalk or curb together with the lot, block, and addition abutting thereon, and the relative position of said proposed sidewalk or curb as to whether it is to be on the front or side. The said application shall be signed by the owner of said described property or his agent. (Ord. 512 § 2, 1966).
7.32.030 Issuance.
Upon the filing of said application, the city clerk/treasurer shall execute a permit for the construction of said sidewalk and/or curb, which permit shall designate the street or streets, along or upon which the same is to be built, the lot, block and addition abutting thereon and the relative position, as to whether front or side, and it shall be provided in said permit that the proposed sidewalk or curb shall only be constructed pursuant to the requirements of the ordinances of the city of Ritzville, and further subject to the inspection and approval of the city water superintendent or any other person designated by the mayor. 7.32.040 Grade approval and inspection.
Upon the issuance of such permit, the city clerk/treasurer shall immediately notify the city water superintendent, or agent designated by the mayor who shall examine the proposed grade for said sidewalk or curb and approve or disapprove the same, and he shall have the right to inspect said sidewalk or curb at any time during its construction to see whether it meets the requirements with respect to incline and grade, and upon the completion of said sidewalk or curb, he shall inspect it and either accept or reject it on behalf of the city. (Ord. 512 § 4, 1966).
7.32.050 Violation – Penalty.
Any violation of the terms of this chapter shall be deemed a misdemeanor and shall be punished by a fine of not less than $25.00 or by imprisonment in the city or county jail for a period of not more than 10 days, or by both such fine and imprisonment, and any sidewalk or curb hereafter constructed except in conformity with the provisions of this chapter shall be deemed a nuisance and the same may be removed under the direction of the city water superintendent, or person designated by the mayor, at the expense of the owner of the abutting property.
