10.05.010 Adoption by reference.

Chapter 308-330 Washington Administrative Code (hereinafter referred to as WAC) governing matters referred to in the title of this chapter has been filed in triplicate with the city clerk and, except for the sections set forth below, and Sections 4, 5, 6, 7, 10, 11, 12, and 23 of Chapter 275, Laws of 1994 and RCW 46.20.730 as amended by Section 23 of Chapter 275, Laws of 1994, are hereby adopted by reference into this chapter, and shall hereafter be in effect in the city of Roslyn in the same manner as if they were fully set out herein:

10.05.020 Rollerskating and skateboarding.

Rollerskating and skateboarding on any streets or sidewalks within the downtown core area, which shall mean Pennsylvania Avenue from Fourth Street to First Street and Highway 903, is hereby declared to be a nuisance and is prohibited. In all other areas of the city of Roslyn where rollerskating and skateboarding are not specifically prohibited by this chapter, those individuals who utilize rollerskates and/or skateboards shall follow all traffic safety rules and regulations of the city of Roslyn, county of Kittitas and state of Washington. 10.05.030 Sidewalks and parking strips.

It shall be unlawful to drive, lead or ride any horse or other large animal or any bicycle, automobile or other vehicle upon, across or along any sidewalk or parking strip, except where absolutely necessary for ingress or egress from abutting property, provided this shall not be construed to prohibit the plowing or clearing of sidewalks by the city. 10.05.040 Penalties.

Unless otherwise provided by any of the above referenced sections of the WAC in RMC 10.05.010, upon conviction of violation of any of the provisions or adopted statutes of this chapter, the violator shall be punished by a fine not to exceed $250.00, and if otherwise so provided, the punishment or sanctions so provided by the above referenced sections of the RCW, as they may be amended, shall apply and control. 10.05.050 Construction of provisions.

If any of the statutes herewith adopted refer to matters preempted by the state of Washington, or to matters which are expressly to be done or performed only by state or county officials, this chapter shall not be construed to direct or require or empower city officials to do or perform such matters. 10.05.060 Motorcycle regulations.

Every motorcycle and every motor-driven cycle shall have its head and tail lamps lighted whenever such vehicle is in motion upon a highway. [Ord. 524 § 8, 1975.]

10.05.070 Bicycle regulations.

Every person operating a bicycle shall ride as near to the right side of the roadway as practicable and may utilize the shoulder of the roadway or any specially designed bicycle lane if such exists. [Ord. 524 § 9, 1975.]

10.05.080 Off-road vehicles.

No wheeled, motorized off-road vehicle shall be operated on public or private land within the city of Roslyn; provided, however, such prohibition shall not apply to private land if the operator of the wheeled motorized vehicle owns the private land, has a lease on the private land on which the vehicle is operated, or is licensed by the landowner to use said vehicle upon the owner’s private land. For purposes of this chapter, the definition of “wheeled, motorized off-road vehicle” shall include motorcycles, except that properly licensed motorcycles may be operated on public highways, and shall further include ORVs, ATVs, and other wheeled, motorized vehicles not licensable for use on public highways. Upon conviction for a violation of this section, a violator shall be punished as set forth in RMC 10.05.040. This section shall not apply to the operation of a motor vehicle in a private driveway or private parking lot, nor to the operation of a properly licensed motor vehicle in a public parking lot or public parking area. 10.05.090 Motorized vehicles on the Coal Mines Trail.

Motorized vehicles are prohibited on the Coal Mines Trail within the city limits of the city of Roslyn, except for that portion of the trail from Pennsylvania Avenue East to Washington Avenue East by any route through Roslyn, including all streets and rights-of-way. Snowmobiles are allowed on the trail when the trail is covered by snow and ice. The provisions of Chapter 10.25 RMC shall apply. [Ord. 867 § 1, 1998; Ord. 849 § 1, 1997.]

10.05.100 Crossing yellow pavement marking on West Pennsylvania Avenue.

No vehicle shall be driven over, across or within the 18-inch solid yellow line dividing West Pennsylvania Avenue between First and Second Streets. A violation of this section is a civil traffic infraction and the penalty shall be $71.00. [Ord. 878 § 1, 1999.]
