12.15.010 Park and facility fees and deposits.

A. Fees and Deposit. A fee shall be charged for the exclusive use and reservation of the city park, also known as Pioneer Park and Runje Field, as set forth from time to time by resolution in accordance with RMC 3.05.010. Park and facility use shall also require a deposit as set forth by resolution.

B. Rate Reduced. The use rate set by resolution of the city council for the meeting room or the city parks by nonprofit tax exempt organizations shall be 50 percent of the flat rate, with proof of tax exempt status.

C. Fee and Deposit Waived. Except as provided below, no rental fee or deposit shall be required for the following users or uses of the meeting room or use of a city park:

1. Use by the city of Roslyn for official purposes, including, without limitation, Roslyn parks and recreation programs;

2. Limited use by state or local governmental agencies for official government purposes;

3. Use by any person, association, partnership, organization, company, or corporation for activities or events that are sponsored by the Roslyn School District and complying with policies established by the mayor;

4. Use by any person, association, partnership, organization, company, or corporation for activities or events that are funded or sponsored in whole or in part by the city of Roslyn;

5. Use by a nonprofit tax exempt organization to provide social services that are available to residents of Roslyn; provided, that no fee is charged for attendance at the event/activity utilizing the meeting room or city park; or

6. Use by the events specifically listed in RMC 12.15.030.

D. Waiver Required. In order for an applicant to have the fee or deposit waived as set forth above, the mayor, or his or her designee, must review the application and request and grant a waiver of the fees and/or deposit only after finding that the applicant meets the criteria set out in subsection C of this section.

E. Expenses. In addition to any fees, the applicant shall also pay any expenses for fire, police, medical services, parks, and public works crews needed for coverage and cleanup at the special event. These expenses shall be prepaid and the responsibility of the applicant/permittee, even if the rental fee has been waived. The applicant shall also comply with all provisions for special use permits in accordance with RMC 12.180.030 if the use is determined by the city to be a special event or use. 12.15.020 Reservations.

A. Procedure. The city will schedule reservations and collect appropriate fees for the exclusive rental of the meeting room and city park facilities. Applications and regulations for the use of the meeting room and park facilities can be picked up at City Hall during normal business hours. Reservations will not be made or deemed complete until the application is returned to City Hall, signed by the city and all appropriate fees have been paid. Reservations may be made up to one year prior to the date of the event subject to the provisions set out in RMC 12.15.030 regarding priority.

B. Conditions. The city reserves the right to make changes in scheduling, if in the sole judgment of the mayor, or his or her designee, the meeting room or any city park is needed for an activity or event for governmental purposes, including by way of example and not limitation scheduling of a special or emergency meeting of the city council or planning commission. The city reserves the right to, without recourse to the city, cancel a reservation and refund any prepaid deposits in the event that the reserved park or facility, in the sole judgment of the mayor or his/her designee, becomes unsafe for use, requires emergency maintenance to render the facility safe, or otherwise requires unplanned maintenance that, taking into consideration cost and availability of resources, cannot reasonably be performed at another time.

C. Requirements. Prior to the issuance of a reservation permit for the use of the meeting room or a city park, the permit applicant and authorized officer of the sponsoring group or organization must agree to meet all of the conditions contained in this chapter as well as agree to reimburse the city of Roslyn for any costs incurred by the city in repairing damage to city property in connection with the permitted event that exceed the damage deposit. 12.15.030 Preferences for use of park facilities for certain historical and cultural community events.

The following events are deemed to have historical and/or cultural significance to the city of Roslyn and shall have the following preferences for the use of city park facilities:

Roslyn Coal Miner’s Days:

Labor Day Weekend

Croatian Picnic:

Third Sunday in July

Black Pioneer Picnic:

First Saturday in August

Run to Roslyn:

Third Sunday in August

In order for the above preferences to be officially reserved, each organization must fill out an application and confirm the dates being reserved or request a change to the dates no later than January 31st of each year. [Ord. 1034 § 4, 2008.]

12.15.040 Alcohol permitted when.

Alcohol shall not be permitted in any city park, this includes Pioneer Park, Runje Field, Kiwanis Park, and Centennial Park, without a Washington State Liquor Control Board banquet permit. [Ord. 814, 1996.]

12.15.050 Golf prohibited.

Playing golf is prohibited in any city park, including Pioneer Park, Runje Field, Kiwanis Park, and Centennial Park. [Ord. 864 § 1, 1998.]

12.15.060 Dogs prohibited within Centennial Park.

No dog, whether it is accompanied by a person or on a leash, is allowed within the perimeters of the fenced area of Centennial Park. [Ord. 848 § 1, 1997.]

12.15.070 Park hours.

No one shall be allowed in any city park between the hours of 9:00 p.m. and 5:00 a.m. unless specific written authorization for such use is contained in a special use permit that has been issued pursuant to the provisions of this chapter and Chapter 12.180 RCC. 12.15.080 Parking at city parks.

Parking on the playing fields at Pioneer Park is not permitted unless specific written authorization for such use is contained in a special use permit that has been issued pursuant to the provisions of this chapter and Chapter 12.180 RCC.

If permission is granted, all sprinkler heads and lines shall be marked beforehand by the city crew. Failure of the crew to mark all heads or lines shall not be a defense if damage occurs to the sprinklers. If parking on the fields damages any sprinkler heads or lines, the renter of the park at that time is liable for damages in the amount of replacement parts and crew labor time to repair said sprinklers and lines. The renter/permittee shall also be responsible for the cost of marking the sprinkler heads and lines as well as all damages that exceed the amount of the damage deposit. 12.15.090 Proof of insurance.

Renters of a city park providing public events shall furnish proof of insurance to the city of Roslyn in addition to any other requirement set out in RCC 12.180.030. The renter shall provide a certificate of insurance evidencing the required insurance before being issued a permit or using the park. The policy shall name the city of Roslyn as additional insured and the limits of renter’s general liability insurance coverage shall be not less than $1,000,000 for each incident of personal injury or death, $1,000,000 aggregate coverage for any single accident or occurrence, and $50,000 property damage coverage. The insurance policy shall contain, or be endorsed to contain, that the renter’s insurance coverage shall be primary insurance and shall be placed with insurers with a current A.M. Best rating of not less than A:VII. [Ord. 1034 § 7, 2008; Ord. 814, 1996.]

12.15.100 Hold harmless.

Renters of the city parks shall defend, indemnify and hold harmless the city, its officers, officials, employees and volunteers from and against any and all claims, suits, actions, or liabilities for injury or death of any person, or for loss or damage to property, which arise out of the use of the park or facilities or from any activity, work or thing done, permitted, or suffered by renter in or about the park or facility, except only such injury or damage as shall have been occasioned by the sole negligence of the city. 12.15.110 Administration.

The mayor or his/her designee is authorized to establish, administer, publish, and implement policies and procedures for the use of the meeting room and city parks that are consistent with this chapter and Chapter 12.180 RCC. Use of the meeting room by the city of Roslyn shall have priority over all other uses. [Ord. 1034 § 9, 2008.]

12.15.120 Violations – Penalties.

Any violation of this chapter shall be a civil infraction and punishable by a fine of not more than $500.00. [Ord. 1034 § 10, 2008; Ord. 864 § 2, 1998.]
