10.10.010 Definitions.

As used in this chapter:

“Compression brakes” means a mechanical device that utilizes the compression of the vehicle’s engine to retard the forward motion of a heavy vehicle. This definition includes, but is not limited to, the terms “exhaust brakes” or “Jake brakes.”

Vehicle, Heavy. “Heavy vehicle,” as used in this chapter, means any vehicle, motor vehicle, truck, truck tractor, trailer or semi trailer or a combination thereof having a gross weight in excess of or licensed for 12,000 pounds. This does not include self-propelled recreational vehicles or motor homes.

Vehicle, Long. “Long vehicle,” as used in this chapter, means any vehicle, motor vehicle, truck, truck tractor, trailer or semi truck or combination thereof having a total length in excess of 25 feet. (Ord. 1136 § 1, 2011).

10.10.020 Heavy vehicle – Prohibited use – Designated.

From and after the effective date of the ordinance codified in this chapter, it is unlawful to operate, drive, move, tow, park, or in any way propel any heavy vehicle over, along, upon, or across any street in the city, except those streets designated in SLMC 10.10.050. No heavy vehicle resting on dollies shall be parked on any street without pads at least 12 inches by 12 inches being placed under the dollies.

No person having charge of any self-propelled recreational vehicle or motor home shall permit or allow the same to remain or park the same in any street, alley, or public right-of-way for a continuous period exceeding 48 hours. (Ord. 1136 § 1, 2011).

10.10.030 Heavy vehicle – Prohibited use – Exceptions.

The limitations set forth in SLMC 10.10.020 shall not apply to the following:

A. Commercial vehicles while engaged in delivering merchandise to businesses and homes within the city limits.

B. Utility vehicles servicing utilities within the city limits.

C. Local garbage collector vehicles operating within the city limits.

D. Construction vehicles may operate within the city limits; however, the owners shall be responsible for wheel rut repairs and/or other damage resulting to streets traveled by construction equipment to the city of Soap Lake and as provided for in RCW 46.44.110 and 46.44.120.

E. Municipal vehicles of the city of Soap Lake.

F. School buses.

G. Vehicles approved by the city used in parades.

H. Mail trucks. (Ord. 1136 § 1, 2011).

10.10.040 Compression brakes.

A. No person shall operate a compression brake device on any heavy vehicle within the city limits.

B. It shall be an affirmative defense of prosecution under this section that the compression brakes were applied in an emergency and were necessary for the protection of persons and/or property.

C. This section shall not apply to emergency vehicles. (Ord. 1136 § 1, 2011).

10.10.050 Heavy vehicle – Routes.

A. The following streets are designated as heavy vehicle routes within the city:

State Route (Highway) 17.

B. Heavy vehicles are subject to SLMC 10.32.020, Restricted Parking – Daisy Street, with the following exception:

Parking longer than two hours, but no more than 24 hours, is only allowed in city limits on Daisy Street at the following locations:

1. 400 block of Daisy Street N, to north end of city limits.

2. Daisy Street N, west side of roadway, between entrances of Smokiam Park. (Ord. 1308 § 1, 2020; Ord. 1136 § 1, 2011).

10.10.060 Long vehicle – Prohibited use – Designated.

From and after the effective date of this chapter, it is unlawful to park a long vehicle on any street in the city except on those streets designated in SLMC 10.10.050. (Ord. 1136 § 1, 2011).

10.10.070 Route posting.

The streets designated as a heavy vehicle and long vehicle route shall be marked with signs in an appropriate manner. (Ord. 1136 § 1, 2011).

10.10.080 Violation – Civil penalty.

Any person violating any provision of this chapter shall be deemed to have committed a civil infraction and shall be punished by the imposition of a nonsuspendable penalty as defined in Chapter 1.10 SLMC. The first violation of any provision of this chapter within a 12-month period shall be a C-11 penalty. The second violation of any provision of this chapter within a 12-month period shall be a C-7 penalty. A third or subsequent violation of any provision of this chapter within a 12-month period shall be a C-4 penalty. (Ord. 1136 § 1, 2011).
