9.05.010 Adoption by reference.
The following titles of the Revised Code of Washington are hereby adopted by reference as if the same were fully set forth herein including all penalty provisions, except that the penalty provisions thereof are superseded by the penalty provisions of this chapter as set forth in SBMC 9.05.040, subject to exclusive jurisdiction by the state. Any reference to felonies or classification of felonies shall refer to the statutes of the state of Washington for definition and prosecution:

9.05.020 Filing.
The ordinance codified in this chapter is adopted in accordance with the provisions of RCW 35A.12.140 and prior to its adoption a copy of the Revised Code of Washington has been made available in the office of the city clerk-treasurer for use and examination by the public. (Ord. 1205 § 4, 1995).
9.05.030 Amendments to Washington statutes automatically included.
The amendment, addition or repeal by the Washington Legislature of any sections of any of the adopted statutes shall be deemed to amend this chapter and the statutes contained herein which are adopted by reference in conformity with the amendment, addition or repeal, and it shall not be necessary for the legislative authority of this city to take any action with respect to such addition, amendment or repeal as provided by RCW 35A.12.140. (Ord. 1205 § 5, 1995).
9.05.040 Violations – Penalties.
Any person, firm, corporation or association violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor or gross misdemeanor as in said chapter provided; and for a misdemeanor shall be subject to a fine of not more than $1,000 and imprisonment for a term not exceeding 90 days or both; and for a gross misdemeanor shall be subject to a fine of not more than $5,000 and imprisonment for a term not exceeding one year or both. In lieu of or in addition to incarceration or fine, offenders may be ordered to serve time in day detention so long as the total time served is not greater than the maximum allowed by law.
