3.19.040 Transfers from trust funds.
Transfers may be made from a trust created and established by this chapter by order of the city manager or the city treasurer only if the transfer is made from appropriations budgeted by the Toppenish city council in such trust fund for the purposes of such approved appropriations or made for purposes of an investment made to benefit the trust in accordance with the Chapter 3.05 TMC; the transfer is made in furtherance of the purposes of the trust; and the transfer is not otherwise prohibited by state law, regulations of the Division of Municipal Corporations of the Office of the State Auditor, the Toppenish Municipal Code, or other ordinances or resolutions of the Toppenish city council. Any moneys in a trust fund at the end of the fiscal year of the city shall not lapse and are not subject to reappropriation by the council to another fund in the adoption of a subsequent budget unless the reappropriation is consistent with the trust and the transfer is not otherwise prohibited by state law or regulations of the Division of Municipal Corporations of the Office of the State Auditor. 3.19.050 Deposits to trust funds.
Gifts, principal and interest from trust investments which are not reinvested shall be deposited into the trust fund for which they are dedicated for the purposes of said trust, and transfers of such gifts, principal and interest may be made only as provided in TMC 3.19.040. (Ord. 2005-2 § 1, 2005).
3.19.060 Cemetery trust fund.
There is created and established a fund to be held in the trust by the city, which fund is named the “cemetery trust fund.”
A. The object and uses of such fund are:
1. Any person may make donations to such fund in addition to the endowed care charges paid for gravesites.
2. Any and all sums so donated shall be paid to the city treasurer, and upon such payment, shall be accepted by the city, and held in trust for the uses and purposes of the fund.
3. The city obligates and binds itself to safely keep the moneys donated to such fund, to invest the same in accordance with Chapter 3.05 TMC, and to use the income so realized in caring for, maintaining and beautifying the lots and the graves thereon, in the manner hereinafter specified.
B. The principal of the cemetery trust fund heretofore established, together with any additions thereto, shall be invested and reinvested, from time to time. All income from the fund shall be used exclusively for the upkeep and maintenance of the portion of such cemetery under “perpetual care.” (Ord. 2005-2 § 1, 2005).
3.19.070 Park progress fund.
There is created and established a fund to be known as the park progress fund.
A. Persons who desire to voluntarily contribute to the improvement of the city’s parks and recreation facilities shall be entitled to do so by indicating the amount of such contribution on the monthly municipal utilities bill and all moneys received by the city treasurer in payment of the bills which represent voluntary contributions as indicated thereon, which moneys shall then be used for capital improvements within the park system of the city.
B. In order to effectuate the provisions of this chapter, the city administration is directed to amend and revise the municipal utilities monthly bill in order to enable individuals or persons desiring to make such contribution to indicate the same thereon and the amount of such contribution, and to further implement such other procedures as are deemed necessary and appropriate to facilitate such program. 3.19.080 Code enforcement revolving fund.
There is created and established the code enforcement revolving fund, which fund shall be utilized in compliance with the Uniform Code for the Abatement of Dangerous Buildings (adopted by TMC 15.01.040) and TMC Title 8 for the purpose of funding and financing private contractors who are engaged by the city to demolish unsafe structures and clean unkempt properties when the owners of such structures or properties fail to respond to notices from the city that such action is needed.
A. The city manager is directed to make a recommendation to the city council concerning the amount of such code enforcement revolving fund and the source of the funds, and are further directed to provide that a primary source of such funds shall be recovery of costs from the owners of unsafe structures and unkempt properties as provided by the above-referenced code provisions. (Ord. 2005-2 § 1, 2005).
3.19.090 Firefighters’ pension fund.
There is created and established a fund to be known as the fire pension fund. Any moneys in the firefighters’ pension fund at the end of the fiscal year shall not lapse except upon reappropriation by the council to another fund in the adoption of a subsequent budget which is made in accordance with any rules, regulations, and other laws governing the use of such funds, and which is not otherwise prohibited by state law or regulations of the Division of Municipal Corporations of the Office of the State Auditor. See RCW 41.16.050 and 41.16.060. (Ord. 2005-2 § 1, 2005).
3.19.100 Volunteer firefighters’ pension fund.
There is created a volunteer firemen’s pension pursuant to Chapter 41.24 RCW. Said pension shall be designated the volunteer firemen’s relief and pension fund and shall consist of:
A. All bequests, fees, gifts, emoluments, or donations given or paid to the fund.
B. An annual fee of $30.00 for each fireman electing to enroll therein, $10.00 of which shall be paid by the city and $20.00 of which shall be paid by the fireman.
C. On or before the first day of March of each year, the city shall pay the amounts collected as set forth above to the State Trust Fund designated as the State of Washington Volunteer Fireman’s Relief and Pension Fund subject to the provisions of RCW 41.24.040, incorporated herein by this reference.
D. There is created and established a board of trustees for the administration of this chapter. The board shall consist of the mayor, city manager, one council member, the chief of the fire department, and one member of the fire department to be elected by the members of such fire department for a term of one year and annually thereafter. The board shall function pursuant to the requirements set forth in Chapter 41.24 RCW.
E. Payment of pensions established pursuant to this chapter shall be paid pursuant to the provisions of Chapter 41.24 RCW as amended. (Ord. 2005-2 § 1, 2005).
